| dc.description.abstract | 본 연구는 로테르담 규칙에서 운송인의 책임기간에 관하여 분석하였다. 우선 헤이그 규칙과 함부르크 규칙에서의 운송인의 책임기간에 대하여 개관하고, 본 규칙에 책임기간의 규정인 제12조의 내용을 분석하였다. 운송인의 책임기간의 약정에 있어서 장소적 제한과 책임기간 중 물품에 대한 운송인의 책임개시와 송하인의 의무의 대응관계를 알아보았다. 또한 FIO약정과 운송인의 책임기간의 관계는 FIO를 명시적으로 약정한 경우 운송인의 책임이 FIO용역에 대해서는 그 기간이 정지되는지를 검토하였다. 이와 더불어 운송인의 책임기간과 운송계약의 조건과 담보의 관계에 대해서 알아보았다. 확약으로서 선박의 감항능력에 대한 운송인의 책임기간은 해상구간에 한정되며, 해상항해의 전 기간에 걸쳐있는 계속적인 의무이다. 계약의 조건으로서 인도에 대한 합의가 있는 경우에 연착과 책임기간과의 관계는 그 책임기간 동안 인도지연이 발생한 것이 되어 경제적 손해를 보상받을 수 있게 된다. | - |
