올림픽에서 발생한 심판의 오심행위에 대한 유형 정의와 민사법리 적용

Abstract

The purpose of this study was to discuss and analyze a wrong call case of women’s fencing semi final match during 2012 London Olympic Games in a view of the civil law of England. Securing basic rights of consumers and civil victims and preventing recurrence of wrong call legally would be contribute on the successful holding 2018 Pyungchang Winter Olympic Games and other types of mega sport event in future. However, the court of arbitration for sport, a conciliation procedure structure of International Olympic Committee, did not function flawlessly, even if material financial damages have occurred without any legal notices. It is a more cruel irony that few has a feeling of civil duty, leaving criminal duty aside, against the damages. Therefore, a fact of just few of have been conducted in a view of civil law in academically. This research investigated and analyzed the Shin case with wrong call during 2012 London Olympic Games with in view of England civil law. Several suggestions are included in the end of this research and expected possibly to apply and maximize the success for the 2018 Pyungchang Winter Olympic Games.
