Abstract: This study investigates public responses to artificial intelligence (AI) in court-annexed mediation—a setting in which disputing parties retain decision-making authority, unlike the adjudication contexts examined in prior research. Drawing on procedural justice theory, the study develops a role-based framework distinguishing between AI&amp;apos;s procedural function (chatbot mediator) and substantive function (AI-generated settlement proposal), and tests how each role shapes fairness perceptions, perceived accuracy, and behavioral outcomes through distinct perceptual pathways. Using a web-based experiment with 1000 participants, the study also examines whether the effectiveness of transparency mechanisms depends on whether explanation types align with the role the actor plays in the mediation process. Results indicate that initial public skepticism toward AI mediation is significant but attenuates after participants engage with the process and review the settlement proposal (mixed-effects: drafted-by-AI × stage 1 ≈ 0.40; chatbot × stage 1 ≈ 0.24). AI-generated plans were judged significantly fairer (b ≈ 0.25, p &amp;lt; 0.05) and more accurate (b ≈ 0.22, p &amp;lt; 0.05) than human-drafted ones, and these perceptions mediated acceptance and satisfaction. Transparency strategies produced asymmetric effects: global (rule-level) explanations improved accuracy and acceptance only when paired with procedural AI, whereas local (case-specific) explanations backfired when combined with human-authored proposals. These findings suggest that integrating AI into mediation can enhance both efficiency and perceived legitimacy—provided that parties maintain ultimate decision control and that explanation types are matched to the AI&amp;apos;s procedural or substantive role.</description>

Abstract: 본 논문에서는 “사법영역에서의 고통과 민주주의의 미숙”이라는 주제 하에서 사법권력 역시 국민주권 원리에 따라 국민으로부터 나와야 한다는 점에서 민주주의와 관련이 없다고 할 수는 없지만 전통적으로 이 사법권은 법치국가원리와 보다 밀접한 관련이 있다고 보고서, 사법영역에서의 국민적 고통은 사법부가 법치국가에서 갖추어야 할 사법의 본질과 기능을 제대로 갖추지 못하거나 수행하지 못할 경우에 발생할 수 있다고 판단하여 다음과 같은 하부 주제, 즉 사법의 본질과 법관의 독립, 사법의 조직, 사법의 절차, 그리고 사법절차적 기본권을 전반적으로 고찰해 보았다. 사법이 위에서 언급한 모든 요소들로부터 벗어나는 경우 즉, 사법이 사법의 본질을 일탈하거나 사법이 가져야 할 절차와 조직이 완비되어 있지 않거나, 혹은 헌법상 사법절차적 기본권이나 원리들을 준수하지 않는 경우에, 그 재판은 공정한 재판의 성격으로부터 벗어나 그로부터 멀어질 수밖에 없고, 결국 그로 인하여 법의 왜곡과 기본권침해 그리고 국민적 고통이 초래될 수 밖에 없다.
또한 사법은 입법이나 행정 등 공권력에 의한 국민의 권리침해를 구제해야 하는 기관임에도 불구하고, 그러한 역할을 외부적 혹은 내부적 압력으로 권리구제를 제대로 하지 않거나, 아니면 적극적으로 사법이라고 하는 공권력이 국민의 권리를 침해하는 경우에 어떠한 권리구제절차가 있는지를 고찰해 보았다. 결국 위에서 언급한 헌법상 불문의 기본권인 법적 청문권이나 적법절차원리의 위반, 법률이 정하는 법관에 의하여 공정하고 신속한 재판을 받을 권리 등 사법절차적 기본권을 법원이 침해하는 경우 국민은 그 재판에 대하여 헌법소원심판(재판소원)을 청구할 수 있다(헌법재판소법 제68조 제3항).
그리고 법관이 법을 잘못 해석하여 당사자의 일방을 유리하게 하거나 불리하게 하는 경우 법관은 법왜곡죄(형법 제123조의2)로 처벌을 받을 수 있다. 결국 지난 2월 말 국회 본회의를 통과한 사법개혁 3법 중 법왜곡죄와 재판소원은 둘 다 법관으로부터 국민 기본권을 보호하기 위한, 다시 말하자면 사법영역에서의 국민고통을 구제해 주기 위한 제도인 것이다.
새로 도입된 재판소원은 헌법재판소의 결정에 반하여 기본권을 침해한 경우, 헌법과 법률에서 정한 적법한 절차를 거치지 아니함으로써 기본권을 침해한 경우, 헌법과 법률을 위반함으로써 기본권을 침해한 것이 명백한 경우 중 어느 하나에 해당하면 청구할 수 있으며 다만 확정된 판결이라야 한다(헌재법 제68조 제3항).
민사소송법과 형사소송법, 행정소송법, 헌법재판소법 등 소송법에서 구체화된 절차적 권리들은 대부분 위에서 언급한 사법절차적 기본권의 구체화이다. 그러므로 그 법률위반은 곧 적법절차원리나 기본권의 침해 가능성이 높다.
다만 재판소원은 사실상 초상고심이 될 가능성을 완전히 배제할 수는 없으므로, 재판소원이 과연 진정으로 기본권을 침해한 특수한 헌법(spezifisches Verfassungsrecht)의 문제인지 아니면 단순한 일반 법률(einfaches Recht)상 권리침해의 문제에 머무는 것인지를 잘 구분하여 일반재판에 대한 초상고심이 되지 않도록 앞으로 판례를 잘 축적해 가야 할 것이며, 그 구분론은 설립 이래 재판소원이 헌법소원의 주 심판대상이었던 독일 연방헌법재판소나 학계의 일반재판과 헌법재판의 구분 방법론을 참고하여 계속 발전시켜 가야 할 필요가 있다.
이러한 재판소원을 통하여 사법영역에서 발생하는 국민의 고통을 완전히 제거할 수는 없을지라도, 재판으로 인하여 고통받고 헌법소원을 제기한 청구인들의 눈에서 눈물을 닦아 줄 수 있게 되기를 기대한다.; This article examines the theme of “Public Suffering in the Judicial Sphere and the Immaturity of Democracy.” Although judicial power, like all state authority, derives from the people under the principle of popular sovereignty and therefore cannot be regarded as entirely unrelated to democracy, the judiciary has traditionally been more closely associated with the principle of the rule of law. From this perspective, the article argues that public suffering within the judicial sphere arises when the judiciary fails to embody or properly perform the essential nature and functions required of it under a state governed by the rule of law. Accordingly, the study comprehensively analyzes several related issues: the nature of judicial power and judicial independence, the organization of the judiciary, judicial procedures, and procedural fundamental rights in judicial proceedings.
When the judiciary deviates from its essential nature, lacks the organizational and procedural structures necessary for the administration of justice, or fails to comply with constitutional procedural rights and principles, judicial decisions inevitably depart from the standards of a fair trial. Such departures may lead to distortions of law, violations of fundamental rights, and ultimately public suffering.
The judiciary is entrusted with the responsibility of remedying infringements of citizens’ rights caused by legislative and administrative authorities. However, this study also examines the available remedies when courts fail to fulfill this role because of external or internal pressures, or when judicial power itself actively infringes upon the rights of citizens. In particular, where courts violate judicial procedural fundamental rights—such as the unwritten constitutional right to a legal hearing, the principle of due process, or the right to receive a fair and prompt trial before a judge designated by law—citizens may file a constitutional complaint against a judicial decision (constitutional complaint against judgments) pursuant to Article 68(3) of the Constitutional Court Act.
Furthermore, when a judge intentionally misinterprets the law to benefit or disadvantage one of the parties, the judge may be subject to criminal punishment under the newly established offense of distortion of law (Article 123-2 of the Criminal Act). In this regard, two of the three judicial reform statutes recently passed by the National Assembly—the offense of distortion of law and the constitutional complaint against judgments—share a common objective: the protection of citizens’ fundamental rights against judicial misconduct and the alleviation of public suffering caused within the judicial sphere.
Under the newly introduced constitutional complaint against judgments, a petition may be filed when a final and binding judgment has infringed fundamental rights by contradicting a decision of the Constitutional Court, by violating constitutionally or statutorily prescribed due process requirements, or by clearly violating the Constitution or statutes in a manner that results in a fundamental-rights infringement {Article 68(3) of the Constitutional Court Act}.
Most procedural rights embodied in litigation statutes, including the Civil Procedure Act, the Criminal Procedure Act, the Administrative Litigation Act, and the Constitutional Court Act, represent concrete manifestations of the procedural fundamental rights discussed above. Consequently, violations of these statutory provisions are highly likely to constitute violations of due process or fundamental rights.
At the same time, the possibility that constitutional complaints against judgments may function as a de facto fourth-instance review cannot be entirely excluded. It is therefore necessary to distinguish carefully between cases involving genuine violations of specific constitutional law (spezifisches Verfassungsrecht) and those concerning merely the infringement of rights under ordinary law (einfaches Recht). Future jurisprudence must develop clear standards to prevent constitutional complaints from becoming an additional appellate review of ordinary judicial decisions. In this regard, Korean constitutional jurisprudence should continue to draw upon the experience of the German Federal Constitutional Court, where constitutional complaints against judgments have long constituted a central area of constitutional adjudication, as well as the methodological distinction developed in German constitutional scholarship between ordinary adjudication and constitutional review.
Although constitutional complaints against judgments may not completely eliminate public suffering arising from judicial proceedings, it is hoped that this mechanism will at least help to wipe away the tears of those who have suffered injustice through judicial decisions and have sought relief through constitutional adjudication.</description>

Abstract: 이 연구의 목적은 북한 내 국제사법 관련 문헌을 검토·분석하여 북한의 국제사법 연구 흐름을 파악하고, 북한 연구자들이 자국의 대외민사관계법을 어떻게 해석하고 있는지 확인하는 데 있다. 검토 대상 문헌은 필자들이 입수한 북한의 법률사전과 백과사전, 김일성종합대학의 국제사법학 교과서, 그리고 북한 학술지에 게재된 국제사법 관련 논문이다. 검토 범위는 협의의 국제사법인 저촉원칙에 관한 기본이론과 이와 관련된 북한 대외민사관계법 제1장의 총칙적 규정으로 한정하였다. 검토 결과, 북한의 국제사법 관련 문헌은 북한의 정치·사회적 특성에 기인한 이념적 서술을 포함하고 있으나, 실질적으로는 국제사법 분야의 외부 논의를 학습·수용하려는 경향을 보였다. 즉, 북한의 국제사법 연구자들은 대외경제 활성화라는 정책적 요구 아래 일정 정도 국제적 흐름에 부합하려는 해석과 연구를 전개해 왔다고 평가할 수 있다.; This study aims to trace the trajectory of private international law (hereafter PIL) scholarship in North Korea and to identify how North Korean researchers interpret the Law on External Civil Relations (Taeoe minsa kwan&amp;apos;gye pŏp), by reviewing and analyzing PIL-related materials published within the country. The materials examined comprise North Korean legal dictionaries and encyclopedias, the PIL textbook used at Kim Il Sung University, and PIL-related articles in North Korean academic journals, all obtained by the authors. The scope of review is confined to the basic theory of conflict-of-laws principlesPIL in its narrow senseand to the general provisions in Chapter 1 of the Law on External Civil Relations that correspond to this theoretical framework. The review finds that, although North Korean PIL literature contains ideological narratives attributable to the country&amp;apos;s political and social conditions, in substance it exhibits a tendency to examine and incorporate scholarly discussions outside North Korea. North Korean PIL researchers thus appear to have developed interpretations and analyses that, to a certain degree, align with international trends, under the policy imperative of promoting foreign economic relations.</description>

Abstract: 본 연구는 현대 민주주의 체제 내에서 사법권의 영향력이 비약적으로 확대됨에 따라 제기되고 있는 사법권 독립의 문제를 포착하여 사법권 독립의 의미와 그 한계를 이론적으로 탐색하고, 사법권 책임과의 조화를 모색하는 것을 목적으로 한다. 전통적 권력분립 원리에 기초한 사법권 독립은 입법 및 행정에서의 다수의 폭정으로부터 국민의 자유와 권리를 보호하기 위하여 선출 권력들과의 대등한 지위 확보에 주력하였다. 그러나 오늘날 사법권은 ‘정치의 사법화’ 현상에 따라 사회적 쟁점에 종국적 결정을 내리는 강력한 권력으로 부상하였으며, 이에 따라 사법권 독립을 절대적인 성역으로 간주하기보다 공정한 재판과 법치주의, 그리고 민주주의의 실현을 위한 수단적 가치로 파악해야 한다는 논의가 대두되고 있다. 그러한 맥락에서 사법권 독립은 사건 당사자로부터의 독립이라는 측면에서는 절대적으로 요청되나, 민주적 정당성을 지닌 다른 권력기관 및 국민과의 관계에서는 일정한 수준의 관여와 통제를 수용하는 유연한 개념으로 이해될 필요가 있다. 사법권 독립이 경성의 도그마로 전락하지 않기 위해서는 사법권 독립의 내용과 정도에 대한 조정이 이루어질 수 있게 하여야 한다. 독립의 내용과 수준을 정하는 데 형량되는 대항적 가치로 사법권 책임이 제시되는데 독립과 책임 모두 민주주의와 법치주의를 그 궁극적 목적으로 한다는 점에서 이를 조화롭게 구현하는 논의가 요구된다. 사법권이 독립을 확보하기 위해서는 결국 공정하고 중립적인 재판을 수행하고 그 책임을 다하여 국민으로부터 신뢰를 확보해야 한다. 대중과 정치권력이 납득할 수밖에 없는 치밀하고 투명한 논거를 갖추고 판례의 흐름을 유지하여 예측가능성과 법적 안정성을 제공하여야 한다. 나아가 재판 절차의 공정한 진행과 충분한 청문, 그리고 판결에서 여러 논의를 고려했다는 점이 확인될 수 있을 정도의 종합적이고 풍부한 논증, 그리고 패소자에 대한 예우와 연민, 겸허하고 낮은 자세 등을 법원이 재판과 판결에서 보여주어야 한다. 시민사회 및 정치권력과의 끊임없는 상호작용을 통해 권력 행사의 신뢰를 확보하고 전문성과 도덕성, 공정성을 통한 대중의 지지를 확보하여 사법부가 민주적 책임성을 실천하는 것이 바로 사법권 독립과 책임의 진정한 구현일 것이다.; This study explores the constitutional meaning and limits of judicial independence in response to the dramatic expansion of judicial power within contemporary democratic systems, seeking a theoretical harmony between judicial independence and judicial accountability. Traditionally, judicial independence focused on securing an equal status with elected branches to protect citizens’ liberties from the “tyranny of the majority” in legislative and executive spheres. However, as the “judicialization of politics” has elevated the judiciary into a formidable power that renders final decisions on major social issues, there is a growing discourse that judicial independence should be viewed as a functional instrument for achieving fair trials and the rule of law and democracy rather than an absolute, sacrosanct dogma.
In this context, while independence from case litigants remains an absolute requirement, independence from other democratic branches and the public must be understood as a flexible concept that accommodates a legitimate and reasonable degree of involvement and restriction. To ensure judicial independence does not devolve into mere rhetoric or a rigid dogma, it must be recognized as existing for the benefit of the judicial system, the government, and the people, allowing its level to be adjusted accordingly. Judicial accountability is presented as a counterbalancing value in determining the content and level of independence; however, since both values ultimately serve the goals of democracy and the rule of law, they must be implemented harmoniously.
Ultimately, to secure its independence, the judiciary must earn public trust by conducting fair and neutral trials. The judiciary must provide predictability and legal stability by maintaining consistent precedents supported by transparent and compelling logic. Furthermore, the courts must demonstrate democratic accountability through fair procedures, thorough hearings, and comprehensive reasoning that reflects various arguments. The true realization of judicial independence lies in the judiciary functioning as a core power of democracy—securing public support through expertise, morality, and fairness, while engaging in continuous interaction with elected powers to establish institutional trust.</description>
