헌법재판소 판례에 대한 정치적 영향 분석

Abstract

본 논문은 정치(정권 또는 재판관의 정치적 성향)가 헌법재판에 미친 영향을 자료에 기반해 분석하였다. 주요 결과는 다음과 같다. 정권별 위헌비율을 분석해 보면 김영삼 정권 24%, 김대중 정권 19%로 상대적으로 높고, 노무현 정권 10%, 이명박 정권 11%, 박근혜 정권 9%로 상대적으로 낮다. 진보정권(김대중/노무현)과 보수정권(이명박/박근혜)으로 분류하여 비교해 보면, 진보정권의 위헌비율이 14%, 보수정권의 위헌비율이 10%이다. 두 번째, 일변량 회귀분석(univariate analysis)에서는 정권성향과 재판관 정치성향이 위헌비율과 유의미한 양의 상관관계를 보이고 있다. 정권별 회귀분석 결과, 김영삼, 김대중 정권은 각각 22%, 10% 보수정권에 비해 높은 위헌비율을 보였다. 마지막으로, 정권성향과 재판관 정치성향 중에는 재판관 정치성향이 위헌비율과 보다 상관관계가 높은 것으로 추론된다.

This paper provides empirical evidences for the effects of politics (political attitudes of constitutional justice) on constitutional court decisions. Our main findings are as follows. The rate of unconstitutionality is higher under progressive presidential regimes than conservative ones, which is 14% compared to 10%. The regression analysis shows that presidential regime and political attitudes of constitutional justice is positively associated with the rate of unconstitutionality. The rate of unconstitutionality is higher at the time of president YS. Kim and DJ. Kim than conservative presidential regimes by 22% and 10%, respectively. Finally, the political attitudes of constitutional justice is more likely to be correlated with the rate of unconstitutionality than the political preference of presidential regime.
