Abstract

Our law system is not fully ready for underground development, which could bring legal problems in all kinds of aspects of underground use. Of all the legal issues, the problems concerning land ownership which is automatically connected to other problems, is the first thing to be improved. In these reasons, the purpose of this study is to suggest a solution to improving land ownership related-law dealing with the scope of land ownership, the use of land and compensation for underground use. This study will proceed as follows ; First, this study will approach the problems through analyzing both the relevant legal precedent and law. The second is to extract specific issues by citing related cases. Third, both the raised issues and overseas law system are applied for proposing the effective way for improvement. This study is different from others in that this thesis tried to put more weight on the acquisition of legal right for land. Also, it is characterized by the approach, applied to presenting issues. This work could be a big contribution to utilizing underground under the more systematic law system.
