방송프로그램 편성규제정책에 대한 접근방법 및 방향성에 관한 연구

Abstract

방송을 둘러싼 매체환경의 변화로 인해 방송과 관련된 각종 규제정책의 정당성과 실효성에 대한 다양한 담론이 형성되고 있다. 방송에 대한 내용규제정책의 일환인 방송프로그램 편성규제도 예외는 아니다. 다매체‧다채널시대로 통칭되는 방송매체환경의 변화 속에서 과연 기존의 방송프로그램 편성규제정책을 유지할 필요성이 있는지 여부, 방송프로그램 편성규제정책의 이념적 근거 내지 목적이 여전히 유효한지 여부, 개별 방송프로그램 편성규제정책들의 실효성이나 효과성이 담보되고 있는지 여부 등의 다양한 문제제기와 논의들이 현재 진행중이다. 이 글은 방송프로그램 편성규제의 이념적 근거 내지 목적을 고찰하고, 다매체‧다채널시대로 통칭되는 방송매체환경의 변화 속에서 방송프로그램 편성규제정책에 대한 새로운 접근방법 및 방향성을 모색하고 있다. 보다 구체적으로 향후 방송프로그램 편성규제정책을 설계함에 있어서의 원칙과 기준으로서 방송프로그램 편성규제정책에서의 ‘차별화 대응전략’을 제시하였다. 그리고 차별화 대응전략을 뒷받침하는 명제로서 ‘매체와 채널의 특성’을 고려해야 한다는 점을 주장하였다. 즉 “방송매체와 방송채널의 특성이 그 자체로 방송프로그램의 다양성 확보를 통해서 수용자의 선택권을 보장해 주고 있는지에 따라서 방송프로그램 편성규제의 방식과 정도가 결정되어야 한다”는 명제가 차별화 대응전략의 원칙과 기준으로서 기능할 수 있다고 생각한다. 그리고 매체간‧채널간 차별적 편성규제정책을 위한 정당화모델을 제시하였다.

As the environment of media surrounding broadcasting changes, the diverse discourses is being formed about justifiability and effectiveness of the regulation policies in relation with broadcasting. The regulation of broadcasting programming as one of content regulations of broadcasting is the same. The regulation of broadcasting programming is connected with the freedom of expression, in other words, freedom of broadcasting in a viewpoint of constitutional law. And the regulation of broadcasting programming is a problem of balancing between public interests pursued by the regulation and freedom of broadcasting of broadcasters. This study starts from questions as follows. Firstly, is it needed to maintain current regulation policy of broadcasting programming under the changes of the environment of broadcasting media symbolized as 'multi-media and multi channel era'?. Secondly, is the idealogical rationale or objective of regulation policy of broadcasting programming still meaningful?There is much criticism about current regulation policy of broadcasting programming focusing justifiability and effectiveness of the regulation policy. Especially these days, under the changes of the environment of broadcasting media symbolized as 'multi-media and multi channel era', these critical challenges are becoming more persuasive. Beginning from these questions, this study presents principles and standards to make new approach and direction about the regulation of broadcasting programming as follows. First, this study reviews the idealogical rationale or objective of regulation policy of broadcasting programming. Second, this study emphasizes new approach and direction about the regulation of broadcasting programming. Third, this study proposes discriminatory programming regulation between broadcasting media and channels according to characteristics of broadcasting media and channels. Fourth, this study presents medium-specific model to justify discriminatory programming regulation between broadcasting media and channels.
