정비기반시설 중 도로의 무상양도 조건에 관한 연구 - 서울특별시 무상양도 기준을 중심으로 -

Abstract

The purpose of this study is to review the judicial precedents, and to consider instances of regeneration projects which is related to the system of the gratuitous conveyance, and to grasp the problems and current implication of system. The results of this study is as follows. First, the administrations should transfer the property of infrastructures. Second, the rational improvement of gratuitous conveyance is necessary to compensate their cost of installing the gratuitous contribution infrastructures. Third, the roads which are not defined by law should be included in gratuitous contribution infrastructures. Forth, to reduce the gap between gratuitous contribution and gratuitous conveyance, the legal basis should be establish to give benefits ; tax breaks, incentives, etc.
