Abstract
This paper will analyze two-party talks of China and Taiwan which have been pushed ahead with as they reinforce their various non-governmental cross-straits exchanges and cooperation. In particular, this paper will analyze the negotiation systems of China and Taiwan and their operating cases by focusing on two quasi-intergovernmental organizations, ‘ARATS(the Association for Relations Across the Taiwan Straits)’ of China and ‘SEF(the Strait Exchange Foundation)’ of Taiwan founded to make a detour around the limits of promoting no bilateral intergovernmental negotiation. In fact, the cross-straits relation can be changed from extreme confrontation of the past including using military force to ‘quasi-unification state’-promoting ECFA(Economic Cooperation Framework Agreement) equivalent to FTA and allowing millions of people to visit each other with direct flight- by the incessant meetings of China and Taiwan through the ARATS and SEF. As mentioned above, the ARATS and SEF representing China and Taiwan each are skillfully working as exclusive windows for negotiations. Especially, after the government of President Ma Ying-jeou was launched in 2008, ‘The Third Cooperation between KMT and CCP’ for reconciliationㆍcooperation, win-win of two nations has been actually done by these two organizations. In spite of formally being non-governmental organizations, they are under the supervision of the top leaderships and primary government departments of each country. Therefore, the ARATS and SEF should be the quite useful subjects for investigating the negotiation systems of China and Taiwan and their actual managing state. Considering these points, this paper will concrete upon the following subjects. First of all, the investigation into the background of the establishment of the ARATS and SEF will be conducted. This will clarify their political position and functions. Next, their roles of negotiation and actual cases will be analyzed. This will make the two countries’ detailed negotiation strategies and processes clear. In other words, this is the analyzation of the principles, conditions and ultimate goal they pursue in the process of negotiations. Because the two countries fundamental disagreement with the political status of Taiwan still hampers the bilateral intergovernmental negotiation, the role of the ARATS and SEF seems to be more critical in the future. Particularly, since the pro-China policy of Ma Ying-jeou government is rapidly expanding and the institutionalization of the cross-straits exchanges of the two nations is urgently needed, the negotiation function of the ARATS and SEF is also expected to dramatically grow.
