독일에서의 도난 및 약탈 미술품의 반환 문제

Abstract

일반적으로 문화재, 그 중에서도 특히 미술품을 둘러싼 문제들은 ① 보존, ② 도난과 약탈(전시약탈을 포함하여) 그리고 그 반환, ③ 도품의 선의취득(준거법을 포함하여), ④ 국제적 보호체계, ⑤ 가치산정과 손해배상, ⑥ 보험 등을 둘러싸고 발생한다. 이 점은 우리도 마찬가지이다. 이 글은 독일의 경험을 소재로 하여 그 중에서도 특히 ②의 문제를 집중적으로 다룬다. 이를 통하여 향후 ③과 ④를 살펴보기 위한 기초(관련 사례를 비롯한 문제 상황의 정리)를 다지는 것을 목적으로 한다. 독일의 경우는 역사적인 이유에서 특히 러시아 및 유태인과의 관계가 문제되었는데(러시아와의 관계에서는 주로 피해자[가해자적 측면도 있지만], 유태인과의 관계에서는 가해자의 입장에서), 독일의 경험은 우리와 다른 나라(주로 일본)의 관계에서도 시사하는 바가 있다고 생각한다. 그러나 이 글에서는 그 시사점을 따로 적시하지는 않고, 주로 독일의 경험을 서술하는 데 주력하였다.

The legal problems concerning cultural property, above all fine art works, cover ①conservation, ②theft, plunder(in the wartime, etc.) and reparation, ③bona fide purchase protection(and its applicable law), ④international legislation, ⑤appraisal and damages, and ⑥insurance. This article scrutinize ② among the above, in the light of German experiences. It is hoped thereby to help further discussions of ③ and ④. German has gone through large-scale wars and other armament conflicts, which gave a rise to many legal problems especially with the Russians and the Jews; Germany stood (mostly) plaintiff with one, as well as defendant with the other. The German experiences are expected to come in useful for the Korean problems in relation with other countries such as Japan. Here, all attentions will be focused on explanation of the German experiences, without striving to retrieve any conclusive argumentations.
