도박에서 시간불일치성의 문제 ― 강원랜드 판결의 법경제학적 분석 ―

Abstract

이 논문은 도박사업자의 불법행위로 인한 고객의 손해의 배상을 명한 강원랜드 판결(서울중앙지법 2008. 11. 5. 선고, 2006가합102456 판결, 현재 항소심 진행중)에 대한 분석이다. 도박자의 도박중독 및 과다한 도박에 대한 방지조치 등을 행동경제학적 관점과 게임이론적 모형을 활용하여 설명한다. 인간의 선호가 완전합리성을 결여하고 시간불일치성을 나타내기 때문에 단기 편익에 탐닉하는 자기통제의 문제가 발생한다. 이러한 자기통제의 문제를 해결하기위한 여러 방안의 하나로 제 3자에 의한 집행에 의존하는 pre-commitment 방식이 도입된다. 이는 행위자의 선택기회를 스스로 제한하는 규칙을 제정하는 방식이다. 도박 규제법규는 인간이 시간불일치성을 해소하기 위한 pre-commitment 조치로 해석하여 규제법규를 제대로 이행하지 않고 도박자의 피해를 증폭시킨 도박사업자의 책임을 규명한다.

This paper analyses, using a game theoretical approach, the case of [Damages] Seoul Central District Court Decision 2006GaHap102456 Decided November 5, 2008(now pending on appeal), in whose ruling a casino(defendant) was ordered to damages to a client, having illegally falling its duties of care toward him. Gambling addiction and responsible gambling is analyzed using game theoretic model from the behavioral economics perspectives. The perfect rationality of homo economicus is suspected in behavioral economics framework. As the preference of human shows time inconsistency, people may indulge in short-term benefits, leading to self-control problem. Sophisticated agents know this bias and voluntarily choose to impose restrictions on their choices, effectively bonding his behavior. The measures of responsible gambling can be understood as pre-commitment devices to address the time inconsistency problem.
