2016년 노동법 중요 판례

Abstract

이 글에서는 법원과 헌법재판소가 선고한 노동 판례 중 12개 판결을 선정하고, 이를 개별적 근로관계법과 집단적 노사관계법 영역으로 구분하여 검토하였다. 위 판결들의 중요한 쟁점은, 근로기준법상 차별금지 사유인 사회적 신분, 기간제법에서 갱신기대권, 출퇴근 재해와 산재보험법의 적용 여부, 저성과자의 평가기간의 단축과 취업규칙 불이익변경, 개인적인 사유로 입은 장애와 사용자의 고용유지의무, 고용간주된 파견근로자의 근로조건, 공격적 직장폐쇄와 임금지급의무, 조합원 채용에 관한 단체협약과 사회질서 위반, 단체협약의 갱신에서 해지권의 제한과 노조법의 강행성, 근로시간면제와 부당노동행위, 노동조합의 조직형태 변경과 주체, 회사의 지원으로 설립된 노동조합의 자주성과 무효 여부 등이다.

This article reviews 12 major decisions of the Supreme Court and the Constitutional Court on labor law in 2016. They are categorized according to employment law or labor relation law. The main issues of above decisions are social status as grounds of discrimination on the Labor Standards Act, right of renewal on the fixed-term employment contract, occupational accident by commute, the performance appraisal and amendment of rules, workers with disability and duty of employer, working conditions in regarding the dispatch of worker, aggressive lockout and duty of wage payment, contents of collective agreement and violation of social order, right of termination and collective agreement, time-off system and unfair labor practices, structural changes of trade union and the subject of right, independence of trade union and nullity of establishment.
