How to Write Spine-Related Medical Certificates

Abstract

Study Design: Review article Objectives: It is essential for doctors to assess and treat patients' health, but issuing medical certificates that can be trusted by society is also an important duty. Summary of Literature Review: Advancements in medicine have led to increases in the amount of material that medical students must learn. Therefore, medical school curricula have not properly taught students to write, and many doctors have written them inappropriately, causing problems. Materials and Methods: Review of the relevant articles. Results: A medical certificate contains the patient's personal information and is a document that records not only the results of the doctor's diagnosis of the patient, but also his or her medical judgment, and has legal effect in itself. In principle, a medical referral is a document that conveys a clinical assessment of the patient or an opinion about the future treatment plan to other healthcare providers, and its purpose is to provide information on the patient's treatment. However, since a medical referral also certifies the relevant health condition, it has the same effect as a medical certificate. In addition, since various certificates are required from doctors to reflect social needs, some documents must be written in relation to the diagnosis and medical opinion, in addition to the medical certificate and medical referral that are related to the patient's treatment and care. Conclusions: According to Medical Act Article 17.3., when a request is made to issue a medical certificate, postmortem examination certificate, or other certificate, it cannot be refused without a justifiable reason; thus, the issuance of a medical certificate is mandatory. Therefore, for a doctor's judgment to be accurately expressed in a document, the issuance of a certificate should be recognized as a legal act rather than part of the duty of medical treatment, and its preparation should involve making a judgment as an expert witness. © 2024 Korean Society of Spine Surgery Journal of Korean Society of Spine Surgery.

연구 계획: 문헌 고찰 목적: 의사는 환자의 건강상태를 판단하고 치료하는 것도 중요하지만, 사회의 신뢰를 받는의학적 증명서의 발부도 중요한 의무이다. 선행 연구문헌의 요약: 의학의 발전과 함께 학습량이 많아지면서, 의학적 증명서 작성 교육 등은 의과대학 교육 과정에서 제대로 교육하지 않게 되었고, 의사가 되어 부적절하게 작성하는 경우가 있어, 문제가 발생하는 경우가 많다. 대상 및 방법: 관련 연구 고찰 결과: 진단서는 환자의 개인 정보가 포함되어 있으며, 의사가 환자를 진단한 결과뿐만 아니라, 의학적 판단까지 함께 기록된 문서이고, 그 자체로 법적인 효력이 있다. 소견서는 원칙적으로 환자에 대한 임상적 추정이나 향후 치료계획에 대한 의견을 다른 의료인에게 전달하기 위한 서류로, 환자의 진료 정보를 제공하기 위함이 목적이다. 하지만 소견서도 건강상태를 증명한다는 내용은 다르지 않기 때문에 진단서와 같은 효력을 갖는다. 또한, 사회적 필요에 따라 의사에게 다양한 증명서를 요구하고 있어서, 진단서, 소견서 외에도 환자의 진료 및 치료에 관계되어 작성해야 할 서류들이 있다. 결론: 의료법 제 17조 3항에 따라, 진단서, 검안서 또는 증명서 교부를 요구받은 때에는 정당한 사유없이 거부하지 못하므로, 의학적 증명서 발급은 의무이다. 따라서 문서로서 의사의 판단을 정확하게 표현하기위해, 진료 본연의 업무라기보다는 법률적인 행위로 인식하여 감정인으로서 판단하여 작성해야 할 것이다.
