보편적 노동권을 향한 단상

Abstract

이 글의 목적은 2025. 6. 4.에 시작된 새 정부의 노동정책을 향한 제언이다. 새 정부의 노동정책은 헌법정신과 기본 가치 위에서 노동을 둘러싼 대변화에 조응할 수 있도록 정초(定礎)되고 조경(造景)되어야 한다. 디지털 전환의 기술변화, 기후변화로 인한 상시적 기후위기, 저출산･고령화의 인구구조 변화, 일･생활 양립 등 다양한 사회 가치의 추구로 설명되는 4대 변화는 우리 사회에 일자리 창출, 산업구조 전환, 탈탄소 노동 전환, 돌봄 확대, 일 생활 양립 등을 요구하고, 이러한 요구에 조응하는 첫걸음은 보편적 사회권의 실현이다. 고용보험 확대, 기본소득 도입, 직업교육 강화, 노동법 확대･개편, 보장적 휴식권 확립, 시간 주권적 근로시간제 등은 보편적 사회권 실현을 위한 필수적 사항일 것이다. 보편적 노동권을 향해 노동법은 모두의, 모두를 위한, 모두에 의한 법이어야 한다. 모두의 노동법은 노동하는 국민 모두에게 적용되는 노동법을 지향하고, 이를 위해 특히 5인 미만(4인 이하) 사업장에도 적용되는 근로기준법, 노무제공자에게 적용되는 노동법, 누구나 자신이 가지는 권리와 보호를 쉽게 알게 하는 노동법전을 제안한다. 모두를 위한 노동법은 현재 근로자는 물론이고 미래 세대에도 유익한 노동법을 희망하고, 이를 위해 특히 보편적 휴식 중심의 근로시간제, 정년 연장, 이주노동의 보호 등을 제안한다. 모두에 의한 노동법은 노사가 함께 만드는 사업장과 산업의 법규범을 지향하고, 이를 위해 사업장협정체제로의 전환, 업종별 교섭과 업종별 협약의 확대를 핵심 테마로 한다. 우리의 숙제와 대변화의 과제를 담당할 국가기구의 신설과 개편도 중요하다.

This paper is recommendations for reforming labor policies in a new Government beginning from June 4. of 2025. New labor policies should be based on the fundamental values of the Constitution of Republic of Korea such as a democratic republic, equal protection before the law or rule of law. New labor policies also have to be coped actively with the changing circumstances of world of work; development of technology by digital transition, continuing climate crisis causing by climate change, demographic aging and changes in social values. In order to establish workers’ universal rights, laws concerning employment and labor relations should be laws of the all, for the all, by the all. Labor laws of the all require that they have to be applied to all working people. Accordingly the Labor Standard Act should be applied to workshops using 4 workers or less; new act should be made for the economically dependent workers; unified labor code will be prepared for enhancing legal accessibility of all working people. Labor laws for the all require that they have to be useful to both the present workers and the future workers. For the purpose of this, some policies are necessary introduction of rest-led working time system, extension of retirement age and increasing protections for immigrant workers. Labor laws by the all require work rule based on the consent of both workers and a employer and industrial collective bargaining and agreement.
