| dc.description.abstract | 이 평석 대상판결은 폭설시의 고속도로 관리자가 취하여야 할 제설작업과 교통통제 등의 관리내용을 구체화한 우리나라 최초의 판결이다. 이 사안은 폭설시 고속도로관리자의 관리의무 미흡으로 인하여 많은 차량이 고속도로상에 고립된 사고를 다룬 것으로 유명하다. 이 판결은 고속도로 관리자는 사전에 충분한 인적·물적 설비를 갖추어 강설시 신속한 제설작업을 할 의무가 있고, 필요한 경우에는 교통통제 등의 조치를 취하여 고속도로로서의 최소한 기능을 유지하거나 신속히 회복할 수 있도록 하는 관리의무가 있다는 점을 판시하였다. 그리고, 이 판결은 강설시 고속도로가 일반도로에 비하여 보다 높은 수준의 제설작업 및 교통통제를 하여야 한다는 점을 최초로 판시한 점에서 의미가 있는 판결이다. | - |
