- Abstract
- 본 논문은 연지급신용자의 만기 전 할인지급이나 매입에 의한 지급에 의한 상환청구권과 관련하여 영국과 미국법원의 판결을 중심으로 비교분석한 논문이다. 연지급신용장에 의하여 연지급확약서가 발급 된 후 선적서류의 할인 또는 매입이 행해진 경우 그 만기일 전에 신용장거래의 사기사실이 밝혀진다면 지정은행의 연지급은행에 대한 상환청구권에 대해서 연지급은행이 지급거절을 할 수 있느냐에 대한 판결이었다. 우선 영국법원에서는 UCP500과 영국의 형평법에 근거하여 지급거절할 수 있다고 판결하였고, 미국법원에서는 UCP600과 미국의 UCC에 근거하여 연지급은행이 연지급확약서를 발급한 이상 지정은행의 상환청구권을 거절할 수 없다고 판결 하였다. 이 두 판결은 연지급신용장의 만기 전 할인 또는 매입가능성의 문제와 연지급은행의 사기거래에 의한 방위권 행사가능성 유무의 문제로서 국내외 학계에서도 많은 논쟁이 있었다. 따라서 본 논문에서는 이러한 연지급신용장의 영국법원과 미국법원의 두 판결을 상호 비교 분석하고 그 판결이유와 근거에 대해서 검토함으로서 향후 연지급신용장의 거래의 활성화와 문제점을 방지하기 위한 대응방침을 제시해보기로 하였다.
