- 이 글에서는 대법원이 2014년에 선고한 판결 또는 고지한 결정 중에서 도산법 분야의 주요한쟁점을 다룬 것을 소개하고 논의한다. 이 판결 등에서는 쌍무계약 해제로 인한 손해배상 범위 문제의준거법, 의결권 액수의 확정소송 대상 여부, 채권자간 변제순위 합의의 회생절차상 효력, 양도담보된회생채권의 출자전환시 피담보채권의 변제 여부 등의 쟁점이 다루어졌다.
