- Abstract
- 개인정보보호법의 처벌 규정은 매우 강력하다고 한다. 그러나 개인정보보호법 위반에 대한 처벌은 매우 약하게 이루어지고 있다. 정부는 대규모 개인정보 유출사고가 발생하면 재발방지를 위하여 처벌 규정을 강화하였으나 개인정보 유출 등 법 위반은 지속적으로 발생하고 있다. 강력한 처벌 규정이 개인정보처리자의 개인정보 보호 수준 제고에 실효성이 있는지 의문이 생긴다. 이에 개인정보보호법과 외국의 처벌 규정과 처벌 사례를 분석하고 이를 근거로 개인정보보호법 위반에 대한 합리적인 처벌 방안을 모색하고자 한다.
