아베(安倍) 정권의 집단적자위권에 관한 헌법 해석변경: 내용, 이유 및 논리

Abstract

이 논문의 목적은 일본 아베(安倍晋三) 내각이 2014년7월1일 결정한 집단적자위권행사 허용에 관련된 법적 정합성을 분석하는 것이다. 또한 이 논문에서는 아베 내각이집단적자위권 행사 허용을 결정하기 위해서 자위대 역할 확대를 요청한 미국의 입장을분석했다. 헌법해석의 변경과 개헌론을 비교하면서 헌법해석 변경을 하게된 정치적 과정을 분석했다. 집단적자위권이 행사되기 위해서는 제도적으로 필요한 조치가 포함된법률이 성립되어야 하지만 아베 정권은 일본 국민정서를 고려하여 법률제정을 지연시키고 있다고 주장한다. 아베 내각의 집단적자위권 요인 결정이 한국 국익에 미치는 영향을 평가하기 위해서는 첫째, 미일동맹 체제강화가 한반도 안보 확대에 유익하지만, 둘째, 미국이 아베의 역사수정주의 입장까지 용인하는 것은 아니라는 점을 본 논문에서는 주장한다.

The purpose of this paper is to analyze the domestic political process of Prime Minister Abe’s decision to recognize Japan’s right to exercise collective self-defense expecially from the aspect of government’s legal legitimization in the Japanese Diet. This paper argues that Abe Cabinet decision will remove Japan’s constitutional constraints on the Self Defense Force to allow for a wider range of political options in international disputes. It also argues that the calls from the U.S. for Japan to become a ‘full-partner’ in the alliance and for lifting constitutional ban to exercise the collective self-defense played a positive role in the Abe Cabinet decision on July 1, 2014.
