대한민국헌법(1948)의 형성에 외국 헌법이 미친 영향— 그 기본원리·기본가치·기본제도의 비교법적 연원

Abstract

본 논문에서 필자는 대한민국헌법(1948)의 전문, 총강, 국민의 권리의무, 경제, 지방자치, 헌법개정 등 총 6개 부분의 제 규정들에 대한 역사적·비교법적 영향관계를 헌법 텍스트의 정량적 비교 분석을 통해 밝혀냈다. 우선, 대한민국헌법(1948)의 분석대상 각 규정에 대한 특정 헌법 텍스트의 영향력 수치를 ① 텍스트의 유사성과 ② 전거의 유무라는 두 차원의 기준에 따라 측정했다. 전자에서는 헌법 텍스트의 대부분 또는 상당 부분이 일치하는 사례와 그 일부분만이 일치하는 사례 및 유사성을 전혀 인정할 수 없는 사례로 분류했고, 후자에서는 역사적·비교법적 전거가 구체적·직접적으로 적시된 사례와 일반적·간접적으로만 적시된 사례 및 어떠한 전거도 발견되지 않는 사례로 분류했다. 그리하여 그 영향력 수치를 1.0, 0.8, 0.6, 0.4, 0.2, 0.0 등 총 여섯 단계로 등급화 하여 절대치·상대치를 각각 구분 측정했다. 이처럼 대한민국헌법(1948)의 분석대상 제 규정에 대한 각종 헌법 텍스트의 영향력 수치를 산출·합산한 결과 다음과 같은 결론을 얻었다. 우리 헌법문서의 영향력 수치(절대치 비중 51.3%, 상대치 비중 48.7%)와 외국 헌법문서의 그것(절대치 비중 48.7%, 상대치 비중 51.3%)은 거의 비슷했으며, 전거가 밝혀진 경우(절대치 비중 71.7%, 상대치 비중 68.3%)가 밝혀지지 않은 경우(절대치 비중 28.3%, 상대치 비중 31.7%)보다 영향력 수치가 높은 것으로 나타났다. 영향력 수치는 해방기 헌법문서가 가장 높았고(절대치 비중 40.7%, 상대치 비중 36.5%), 외국 헌법문서 중에는 미국 헌법문서의 영향력 수치가 가장 높았으며(절대치 비중 15.2%, 상대치 비중 17.7%), 이어 일본·중국·독일 헌법문서의 순서로 나타났다(절대치 비중 각각 10.5%·8.4%·6.9%, 상대치 비중 각각 13.0%·7.4%·7.0%). 구미 헌법문서의 영향력 수치는 전거가 밝혀진 경우(절대치 비중 18.5%, 상대치 비중 17.9%)가 밝혀지지 않은 경우(절대치 비중 10.3%, 상대치 비중 12.0%)보다 높은 반면, 아시아 헌법문서의 영향력 수치는 전거가 밝혀지지 않은 경우(절대치 비중 13.5%, 상대치 비중 16.0%)가 밝혀진 경우(절대치 비중 6.3%, 상대치 비중 5.4%)보다 높게 나타났다. 영향력 수치의 집중·분산 정도에 있어서도, 아시아 헌법문서의 경우(0.37)가 구미 헌법문서의 경우(0.44)보다 분산적인 것으로 나타났다.

Where did our “first Constitution” get its texts from? Was it influenced mainly by contemporary foreign constitutions or by our own historical documents? To answer this question, I attempted a quantitative analysis regarding the textual origins of the 1948 Constitution of Korea. I collected the possible textual origins of the provisions of its six parts: Preamble, General Provisions, Rights and Duties of Citizens, Economy, Local Autonomy, and Amendment to the Constitution. Then I graded their “influence scores” as 0.0, 0.2, 0.4, 0.6, 0.8, 1.0, with two criteria: the resemblance of texts and the existence of references. By the total amount of these scores, I could show the different degrees and aspects of textual influence on the provisions of each part of the Constitution. Regardless of meaningful differences among the six parts of the Constitution, I could draw some general conclusions. First, the total influence scores of our own historical documents were almost same as those of foreign constitutional documents. Second, among the collected textual origins, our own constitutional documents during 1945~1948 recorded the highest total influence scores. Among the foreign constitutional documents, those of the Unites States recorded the highest total influence scores. Third, more of the Western constitutional documents had direct or indirect references, whereas more of the Asian ones didn't. The textual influence of the Western constitutional documents on the 1948 Constitution was more concentrated than dispersed, whereas that of the Asian ones was more dispersed than concentrated.
