교육감 선출제도에 관한 연구: 이해관계자에 대한 인식조사를 중심으로

Abstract

지방교육자치의 변화와 함께 교육감 선출제도는 지속적으로 변화하여 왔다. 변화의 방향은 헌법에서 보장하고 있는 지방교육자치의 기본가치, 즉 교육의 자주성, 전문성, 정치적 중립성, 그리고 민주성 간의 균형이다. 기본가치와 관련된 다양한 제도에 대한 이해관계자들의 인식을 조사한 결과, 주민전체가 참여하는 직선제에 대한 선호가 높은 동시에 교육감의 전문성에 대한 요구가 높았다. 또한 교육감 선출과정에서 정당의 관여, 즉 정당의 후보 공천, 당원의 출마, 선거운동에의 정당 참여 등을 배제하는 것을 선호하였다. 그리고 일부 학자들이 주장하고 있는 교육감과 시도지사의 러닝메이트제나 공동등록제에 대하여도 반대하고 있다. 다만 교원단체 등의 단순한 지지의사 표명은 허용하자는 주장이 많았다. 그리고 시도별로 교육감선출제도를 달리 정하자는 일부의 주장에 대하여도 반대 의견이 다수를 차지하였다. 대체로 이해관계자들의 인식은 현행 교육감 선출제도를 어느 정도 유지해나가는 것을 선호하였다. 다만 행정의 효율성측면에서 다소의 보완이 필요할 것으로 판단된다. 이러한 결과에 비추어 볼 때, 교육감 선출제도의 개선은 급진적 개혁방식보다는 시간을 가지고 작용과 부작용을 엄밀하게 검증해 가면서 시행착오를 최소화할 수 있도록 점진적으로 이루어져야 한다.

There have been continual changes in the institutions of local educational autonomy and election system of superintendents. The point of changes is the balance of basic values, i.e., independence, professionalism, political neutrality and democracy. I surveyed the perception of the persons concerned. As a result, most of all prefer direct election with the participation of citizens. Concurrently they don’t prefer political parties’s participation such as public recommendation, candidacy of a party member, participation of party to election campaign. And they object to running mate system or joint register with the Governor which is supported by some professors. But they permit simple expressions of the teacher’s union. And most of all oppose individual election system which is supposed by some professors. Generally the persons concerned prefer to maintain current election system. But some supplementary systems should be necessary on the ground of efficiency.
