미국 의료보험 개혁법안의 최종 통과과정: 하원의 자동실행규칙의 폐기와 오바마 행정명령의 선택

Abstract

이 글은 2010년 3월말 미국 의료보험개혁의 최종적인 통과과정과 이 과정에서 상원법안의 통과를 위해 고려된 하원의 자동실행규칙의 부상과 폐기를 설명하기 위해서 작성되었다. 하원에서 상원법안을 처리하고 하원수정안을 별개로 제출하여 의료보험개혁이 최종적으로 마감되는 과정에서 민주당 지도부가 자동실행규칙을 고려한 것은 무엇보다도 상원법안의 통과를 위한 민주당 지지의원의 확보가 매우 불투명한 상황이 되었기 때문이다. 그러나 행정명령안 등 오바마 대통령의 노력을 통해서 법안통과에 대한 확실성이 높아지면서 민주당 지도부는 자동실행규칙을 통과를 위한 대안에서 제외하였고, 두 법안에 대해서 별개의 투표를 각각 실시하기로 결정하였다.

The aim of this article is to explain the House Democratic leadership’s considering and abandoning the approach of the self-executing rule during the last minute effort to pass the U.S. health care reform. The Democratic leadership considered resorting to the self-executing rule when they found the passage of the relatively conservative Senate bill uncertain amid the strong House Democrats’ opposition. As enough number of Democrats changed their minds to support the Senate bill after a series of President Obama’s talks and efforts, Speaker Pelosi found the self-executing rule unnecessary and decided that the Senate bill and the House amendment would be voted separately.
