dc.description.abstract본 연구에서는 국제항공운송과 관련된 대법원 2018.3.15. 선고 2017다240496 판례를 분석하였다. 판례는 개별운송계약과 항공화물운송장의 이면약관규정이 상충되는 문제에 있어서 개별운송계약을 우선시 하여 부제소특약의 효력을 인정하지 않았다. 또한 INCOTERMS 2010의 CIP 조건과 판례에서 적용하고 있는 CIP조건에서도 차이점이 있어 혼란을 주고 있다. 향후 국제항공운송에 있어서 송화인과 운송인간에 체결된 운송계약이 별도로 존재하는 경우 운송계약의 이행과 관련 규정 간 충돌과 모순이 발생할 수 있다. 따라서 본 연구에서는 국제상관습의 잘못된적용과 국제항공운송 실무에서의 분쟁 예방에 대한 시사점과 발전방향을 제시하였다.-
dc.description.abstractPurpose : In international air transport there has been a contradiction between the terms of the contract of carriage and the provisions of the air waybill. In this case, the Supreme Court of Korea did not recognize the Contract on Waiver of Litigation of the contract by giving priority to the contract of carriage. Therefore, this study aims at analyzing contradictory application of international trade and conflict of regulations in international air transportation. Research design, data, methodology : This study analyzed the provisions of the International Air Transport Convention, Air Waybill, and the Korean Supreme Court case. Results : The case did not recognize the effect of the Contract on Waiver of Litigation in the case of a conflict between the terms of the individual terms of carriage and the terms and conditions of the air waybill. In addition, INCOTERMS 2010 rules and analysis cases are inconsistent when applying CIP conditions. Conclusions : This study suggests implications and development directions for the misapplication of international commercial practice and conflict prevention in international air transportation practice.-
