남북이산가족문제의 국제인권법적 접근 ― 문제 해결을 위한 법적 논리 보강의 차원에서 ―

Abstract

그동안 한국 정부는 남북이산가족문제를 인도적 사안으로 접근하고 해결을 추구하여 온 것이 사실이다. 하지만 이 같은 접근은 이산가족들이 겪고 있는 인권문제, 특히 북한 당국에 의한 인권침해에 대한 시각이 결여되어 있다고 볼 수 있다. 즉, 인권침해 부분에는 눈을 감고 쌍방의 善意와 인도주의 정신에 기초하여 해결을 추구하자는 다소 안이한 발상이라고 할 것이다. 지난 40년간에 남북관계사를 되돌아보면, 인도적 접근에 따른 이산가족문제 해결실적은 너무나도 초라하다. 그렇다면 이제 보다 정공법을 택할 필요가 있다. 이산가족문제를 북한인권문제의 일부로 이해하고 국제인권법적 접근과 해결을 추구하는 것이 바로 그것이다. 특히 이산가족문제의 해결에 있어 가족권 개념과 더불어 실향민으로서 갖는 여러 가지의 기본적 인권을 원용할 필요가 있다. 이러한 접근시각에서 유엔의 인권기구에 대해 협조와 주선을 요청함으로써 남북이산가족문제 해결을 촉진하도록 해야 할 것이다.

It is true South Korean government has tackled intra-Korean dispersed families issue as one of humanitarian affairs for a long time. Such an approach was problematic in that it did not have North Korean authorities' human rights infringement in mind. Moreover, actual results of reunion of separated families owing to humanitarian approach has not been satisfactory up to the present. After all, it is necessary to adopt a new and direct approach to the subject-matter, namely, finding solutions for intra-Korean dispersed families in terms of international human rights law. In particular, it is high time that we should invoke human rights of “Internally Displaced Persons(IDP)” in addition to “family rights” concept in searching for their basic solutions. Related to this issue, the South Korean government had better utilize good offices or assistance of UN human rights bodies more actively from now on.
