중앙정부의 지방자치단체에 대한 행정적 관여의 실태와 시사점

Abstract

본 연구의 목적은 중앙정부의 지방자치단체에 대한 행정적 관여의 실태를 파악하고 이에 따른 시사점을 도출하고자 하는데 있다. 이를 위해 본 연구는 행정자치부가 2003년에 조사한 상급기관에서 하급기관에 대하여 행하는 승인, 협의, 보고, 명령, 인허가, 심사, 지침, 기준제시 등 각종 관여의 내용을 분석하였다. 실태조사를 통한 분석 결과는 다음과 같다. 첫째, 중앙정부의 지방자치단체에 대한 관여가 일부 부처에 집중되어 있고, 또한 이들 부처에서 법령에 근거하지 않은 관여의 비율이 상대적으로 높다는 점이다. 둘째, 중앙의 지방에 대한 관여의 정도보다 광역의 기초자치단체에 대한 관여의 정도가 더 심각하다는 점이다. 셋째, 권력적 관여의 대표적인 수단이라고 할 수 있는 각종 승인이나 협의를 통한 관여의 비율이 높다는 점이다. 넷째, 여전히 법령에 근거 없이 국가가 자치사무에 대해 지침을 시달하거나 고시, 훈령, 예규, 지시를 통해 지방자치단체에 관여하고 있다는 것이다.

The purpose of this study is to investigate the realities of central government's control of local governments focusing on administrative control. This study analyzed the data related to the various central controls such as approval, consultation, reporting, direction, sanction and approbation, review, guidance, standards, etc. surveyed by the MOGAHA in 2003. The results of the analysis are as follows. First, the central government's control of local governments is concentrated on certain ministries. In these ministries the portion of central control which is not based on laws or ordinances is relatively high. Second, upper-tier local governments' control of lower-tier local governments is more serious than central control. Third, the portion of central control such as approval and consultation which are typical tools of authoritative control is high. Finally, the central government still controls local governments through proclamation, instruction, regulation, and direction.
