조직분리와 경쟁: 최근 해외사례 및 시사점을 중심으로

Abstract

본 논문에서는 최근 EU 및 여러 국가에서 활발히 추진되고 있는 통신분야 지배적 사업자의 조직분리 규제도입 동향과 배경 및 시사점 등을 검토하였다. 최근의 조직분리 추진 경향은 직접적으로는 BT의 Openreach 분리가 성공을 거두면서 자극을 받은 것으로 볼 수 있다. 하지만, 본 논문에서는 조직분리가 검토되고 있는 더욱 근본적인 이유는 필수설비와 병목 규제 필요성에 대한 해석, 서비스 기반 및 설비기반 경쟁의 조화, FTTx로 대표되는 차세대 가입자망의 특성 등과 깊은 관련이 있음을 살펴보았다. 이러한 결과는 융합시대와 BcN 환경의 도래를 맞이하여 바람직한 미래지향적 통신규제체제 모색에 대한 시사점을 제공한다.

This paper studies the recent initiatives of the EU and many other countries to include organizational separation of incumbent telecom operators into the regulatory framework. The current drive is directly influenced by the success of UK Ofcom's decision to functionally separate BT's access network. However, more fundamentally, it is closely related with the issues such as: essential facilities doctrine vs. enduring economic bottleneck, harmonization of service-based and facility-based competition, and characteristics of next generation access network (NGA). Enlightening these issues, this paper provides implications for the building of a future-oriented regulatory framework to cope with convergence trends and BcN deployment.
