헤이그 국제아동탈취협약의 현황과 전망 - 제5회 특별위원회의 논의를 중심으로 -

Abstract

헤이그 국제아동탈취협약(Hague Convention on the Civil Aspects of International Child Abduction) 발효된 지 30여년에 이르고 있으며, 현재 이 협약에 대한 체약국 수는 85개국이다. 이 협약의 목적은 부부가 이혼하거나 별거하게 된 경우 부부 일방이 상대방 배우자의 자녀에 대한 양육권을 침해하여 자녀를 불법적으로 국외로 이동시킨 경우에 자녀를 신속하게 이전의 상거소지로 인도하기 위한 것이다. 국가간의 교류증가로 인하여 국제혼인과 국제이혼이 계속 증가하고 있고 그 결과 이 협약의 주요 내용인 자녀에 대한 문제를 포함하여 많은 법률문제가 발생하고 있다. 이러한 현상은 우리나라에서도 예외가 아니므로 우리나라가 협약에 가입하여야 할 필요성은 점차 증가하고 있다. 우리나라에서도 현재 법무부(ministry of justice)가 중앙당국(Central Authority)으로 지정되어 협약 가입을 위한 준비를 하고 있다. 협약 가입에 필요한 협약의 내용에 대한 연구와 각 체약국의 입법례 및 외국법원의 판례, 그리고 협약의 효율적 이행을 위한 국내이행법률에 대해서는 이미 자세히 연구한 바 있다. 현재 우리나라는 협약 가입 여부가 문제되는 것이 아니라, 체약국이 된 이후 국제사회의 일원으로서 협약을 효과적으로 수행하기 위한 대책을 수립하여야 할 시기라 할 수 있으므로, 이 논문에서는 협약에 대한 특별위원회(The Special Commission to review the operation of the 1980 Hague Child Abduction Convention), 특히 최근 2006년의 제5회 특별위원회의 논의를 중심으로 연구하였다. 구체적으로는 중앙당국의 역할과 법적 원조의 문제, 인도명령 또는 면접교섭권 명령에 대한 집행상의 문제, 협약의 주요개념에 대한 재검토, 면접교섭권의 효과적 이행방안, 자녀의 안전한 인도 확보 방안 등에 대하여 검토하였다. 이에 더하여 특별위원회의 연혁과 제5회 특별위원회에서 보고된 2003년 통계분석 그리고 협약의 효율적 이행을 위한 헤이그 국제사법 회의의 각종의 전자시스템제도(INCADAT, INCASTAT, iCHILD)에 대해서도 소개하였다. 이러한 내용들이 우리나라가 체약국이 되어 협약을 효율적으로 이행하는 데에 도움이 될 수 있기를 바란다.

It has been almost 30 years, since the Hague Convention on the Civil Aspects of International Child Abduction(The 1980 Hague Convention) became effective. The objects of the present Convention are to secure the prompt return of children wrongfully removed to or retained in any Contracting State; and to ensure that rights of custody and of access under the law of one Contracting State are effectively respected in other Contracting States. Currently, the number of contracting states reaches 85, but our country has not signed the convention yet. However, due to the increase in international exchange, international divorce and international marriage are increasing; resulting in legal problems. Korea is no exception, with respect to this phenomenon, and the necessity of Korea's commitment to this convention is increasing, accordingly. In Korea, the Ministry of Justice is appointed as the central authorities to prepare for joining the convention. This study reviews the discussion in the 5th Special Commission to review the operation of the 1980 Hague Child Abduction Convention, as well as the main issues of the convention. The information regarding co-operation among central authority, securing voluntary outcomes, enforcement of return and contact orders, discussion of key convention concepts, securing the safe return of the child are reviewed in details. The results of the analysis are expected to be required for the effective performance of the convention.
