국제운송관습의 변화에 따른 정형거래조건의 해석에 대한 연구

Abstract

1936년 국제상업회의소는 국제상거래를 용이하게 하기 위해서 Incoterms라고 알려진 International Commercial Terms를 발간하였다. 국제상관습은 선박건조 기술의 발달, 컨테이너의 등장, 하역기술의 발달, 항공운송의 등장 등의 변화에 맞게 지속적으로 변화하고 있다. 가장 최근에 개정된 Incoterms 2010은 2011년 1월 1일부터 발효되었으며 운송관습에 대한 많은 변화를 반영하여 개정되었다. 본 논문은 국제상관습 중 특히 운송관습의 변화가 정형거래조건의 개정에 주는 영향을 분석하는 것을 목적으로 한다. 이러한 목적을 위해 첫째, 운송관습을 해상운송, 복합운송, 항공운송으로 구분하여 분석하며 둘째, 운송관습의 변화에 따른 각 Incoterms 개정판에서의 개정사항을 살펴본다. 마지막으로, 본 논문은 Incoterms 2010의 거래조건의 새로운 변화를 관련 당사자들에 게 이해시키는데 기여하고자 한다.

Since 1936, International Chamber of Commerce has published International Commercial Terms, also known as Incoterms, in order to facilitate global commerce. International commercial practice has been constantly changing to reflect alterations, such as the development of ship-building technology, the emergence of a container, the development of unloading technology, and the introduction of air transportation. Most recently revised Incoterms 2010 became effect from January 1, 2011 and it has reflected a lot of changes about transport custom. The purpose of this paper is to analyze the impact of revised trade terms which are changed by international commercial practice in particular the changes of the transportation custom. For this purpose, firstly this study analyzes the change of transport custom separately as marine transport, multimodal transport and air transport. Secondly, this study finds the amendments of each revised Incoterms version according changes of transport custom. Finally, this paper contributes to advise the parties concerned to understand the new changes of the trade terms under Incoterms 2010.
