전자무역관습의 변화에 따른 정형거래조건의 적용상 한계성에 관한 연구

Abstract

지난 수십 년 동안, 무역거래 참여자들, 국가들 그리고 국제기구 사이에서 전자무역에 대한 관심이 증폭되어 왔다. 전자무역은 무역절차의 속도를 향상시켜주고, 비용 절감을 가져다준다. 국제상업회의소에서도 이러한 전자무역의 영향을 인식하고 있었으며 Incoterms안에 전자무역에 대한 규정을 포함하여 왔다. Incoterms는 인도 의무, 매도인으로부터 매수인에게로 위험의 이전, 비용의 분배 그리고 운송서류에 대한 책임 등 여러 가지 요소를 명확하게 정의하고 있다. 본 논문은 국제상관습의 변화 중 특히 전자무역관습의 변화가 정형거래조건의 개정에 미치는 영향을 살펴보는 것을 목적으로 한다.

For past decades, it had seen an explosion of interest in e-Trade between international trade participants, nations and international organization. E-Trade means that the process can be speeded up and that cost can be saved. ICC also was recognized about these impact of e-Trade and had included provisions of e-Trade in Incoterms. Incoterms allow several elements to be precisely defined the delivery obligations, the risk transfer from the seller to the buyer, the distribution of costs and the responsibility for the transportation documents. The purpose of this paper is to study the impact of revised trade terms, which are changed by international commercial practice, in particular, the changes of the e-Trade custom.
