Bittorrent를 통한 온라인저작물 불법공유 문제와 대응방안

Abstract

온라인상에서 무료로 자료를 얻고자 하는 사용자들과 이를 이용하여 경제적 이득을 얻기 위해 정보제공을 하는 자들 간의 이해관계 속에서 토렌트 사이트는 시간이 경과할수록 증가하는 추세이며, 토렌트를 통한 저작권 침해 역시 늘어나고 있다. 토렌트는 기본적으로 개별이용자들이 직접적으로 연결되어 자료를 공유한다는 기존 P2P의 운영방식 위에 완전한 파일을 씨앗파일로 분할하여 자료를 유통시킨다는 토렌트만의 특수한 기술적 방식을 가지고 있다. 그래서 토렌트에서는 기존 P2P와는 다르게 완전한 파일이 아닌 씨앗파일을 통해 공유‧유통되며, 토렌트 정보를 제공하는 사이트는 완전한 파일을 관리하지 않고 단순한 검색 기능만을 제공하거나 링크를 통하여 자료에 접근할 수 있도록 용이하게 돕는 역할만을 수행한다. 이러한 토렌트에서만 나타나는 특수한 형태들에 대해서 현재 법적 논의가 이루어지지 않고 있는 실정이므로, 기존 P2P 사례와 토렌트 사례의 법적 쟁점을 비교해 보고, 토렌트의 특수한 형태를 유형화시켜 어떤 법적 쟁점들이 있는지 살펴볼 필요가 있다. 국내와 국외 판결 그리고 국내의 저작권법에서 온라인상의 저작물 침해 행위를 사이트 운영자 그리고 해당 사이트 이용자로만 나누어 그들의 저작권 침해 행위만을 판단하였다. 하지만 토렌트 프로그램의 경우 씨앗파일이 용량자체가 크지 않기 때문에 공유에 있어서 토렌트 사이트를 반드시 필요로 하지 않는다. 심지어 트위터나 개인블로그를 통해 씨앗파일을 링크하여 제공하는 경우까지 있는 실정이다. 따라서 토렌트 프로그램의 경우 사이트 운영자의 저작권 침해 행위뿐만 아니라 사용자들의 저작권 침해 행위 문제에 대해서도 논의되어야 한다. 즉, 씨앗파일을 이용해 저작물을 공유하게 될 경우 비단 사이트만이 아니라 트위터 혹은 블로그를 통해 씨앗파일의 경로를 인덱스 할 수 있기 때문에 업로더가 사이트 운영자의 역할을 할 수도 있고, 사이트 운영자의 위치에서 다시 업로더 혹은 다운로더가 될 수 있는 변화무쌍한 지위에 서는 것이다. 그렇기 때문에 토렌트 사이트에 대한 법적 쟁점은 이제 단순히 사이트 운영자와 해당 사이트 이용자가 아닌 다운로더, 사이트 운영자, 업로더로 크게 나눈 뒤 그 역할에서 예견될 수 있는 저작권 침해 여부를 다투어야 하는 것이 타당하다. 토렌트에 대한 외국 판례의 입장은 토렌트 또한 기존 P2P와 근본적으로 기술적인 차이가 없으므로 P2P에 대한 판결들과 유사한 논리구조로 토렌트를 판단해야 한다는 것이다. 국내에서 이러한 외국 판결이 수용될 경우 국내 판결 역시 토렌트에 대해서 P2P와 유사한 논리구조를 통해 저작권 침해의 문제를 검토할 수 있다. 하지만 토렌트와 P2P의 기술적 차이를 무시한 외국의 판결을 그대로 수용해야하는지에 대해서는 의문이 있다. 토렌트의 경우 P2P와는 달리 씨앗파일을 통해 원본파일의 다운로드가 이루어지기 때문에 P2P에서 볼 수 없는 토렌트에서만의 특수한 유형의 저작권 침해가 일어날 수 있기 때문이다. 특히 씨앗파일만을 업로드하거나 다운로드하는 경우나 마그넷 링크를 통해 씨앗파일을 업로드한 경우에 발생할 수 있는 상황과 이에 대한 법적 논의가 필요하다. 토렌트를 통한 저작물들의 불법공유에 대하여 기술적‧법률적 대응조치가 취해져야 할 것이다. 저작권보호센터 등의 정부차원에서 토렌트 사이트에 대한 모니터링, 필터링 강화와 저작권자들의 저작물등록을 통한 복제방지기술 적용이 하나의 대응방안이 될 수 있다. 또한 제도적으로 기존 P2P와는 다른, 새로운 유형의 토렌트 사이트를 단속 및 처벌 할 수 있는 법적인 토대와 근거를 마련하는 것이 무분별한 저작물 불법공유에 대한 기준을 확립하는 길이다. 토렌트의 등장배경과 열풍에는 기존의 P2P에 비하여 토렌트 기술만의 획기적인 장점에 기인한다. 토렌트는 기존 P2P에 비하여 속도, 안정성, 효과 및 효율성 등에서 장점을 가지고 있다. 때문에 단순히 토렌트를 판단함에 있어 저작권법상의 침해 여부를 가리는 것에 치우치지 말고, 불법적인 공유를 차단하면서 동시에 토렌트의 순기능과 장점을 활용시킬 수 있는 상생의 길을 모색하는 노력으로 이들의 균형점을 모색하여야 한다.

Within the relationship between users who are searching for free data online and those who are trying to make a profit by supplying information to these users, torrent sites are continuously increasing, leading to increased copyright violations. Torrents are basically individual users connected through the internet who are sharing data, which is fundamentally the same system as P2P, with the only difference being that torrents incorporate a unique technology that takes whole files and partition them into seed files to be shared. There are currently no legal discussions in regards to this unique type of data transferring in torrent sharing, and thus there is a need to examine the legal issues between the previous P2P cases and the current torrent situation to figure out what legal issues may exist. The position of foreign precedents in regards to torrents is that it is fundamentally the same as previous P2P systems, with no significant technological difference, and therefore torrents should be judged based on similar logical structures of past judgments that P2P systems received. If such foreign judgments are accepted, domestic judgments on torrents would examine the issue of copyright violation based on similar logical structures that were used for P2P cases. However, there is the question of whether or not the foreign judgments should be accepted when considering the blatant disregard for the difference in technologies between torrents and P2P systems. Torrents, unlike P2P systems, utilize seed files to download the original files, and therefore a unique form of copyright violation only seen in torrents may arise. Legal discussions regarding this matter are necessary. A technical and legal response to the illegal sharing of copyrighted material through torrents is imperative. Possible solutions may be the monitoring of torrent sites by government agencies such as the Copyright Protection Center, or enhanced filtering and copy protection techniques for copyrighted material. In addition, preparing the legal foundation and evidence to control and prosecute torrents, which is the systematically new form of the older P2P system, is the way to establish a standard on the thoughtless violating and illegal sharing of copyrighted material. Compared to the previous P2P systems, the appearance and widespread usage of torrents arise from the ground-breaking technological advantages that torrents possess. Torrents are faster, more stable, more effective, and more efficient than previous P2P systems. Therefore, instead of focusing only on how to judge torrents for the copyright violations they are causing, efforts should be made to not only find a way to neutralize the illegal transferring of data, but at the same time utilize the positive properties that torrents can provide as well, ultimately creating a balance of regulation and technological advancement.
