저작재산권 제한사유로서의 도서관 등에서의 복제에 관한 비교법적 연구

Abstract

저작재산권은 저작물의 이용으로부터 생기는 경제적 이익을 보호하기 위한 권리이다. 저작재산권에 포함되는 권리에는 복제권, 공중송신권, 공연권, 전시권, 배포권, 대여권, 2차적 저작물 작성권 등이 있다. 그러나 일정한 사유가 충족되는 경우에는 저작물의 자유로운 이용을 허용하는데 이것이 저작재산권 제한사유이고, 이중 저작권법 제31조에서 도서관 등에서의 복제를 규정하고 있다. 도서관 등에서의 복제는 도서관 등에 보관된 도서 ․ 문서 ․ 기록 그 밖의 자료를 복제할 수 있는데 이때 저작권법에서는 3가지 요건이 필요하다. 이용자의 요구에 의한 복제, 도서 등의 자체 보존을 위한 복제, 다른 도서관 등의 요구에 따른 구하기 어려운 도서 등의 보존을 위한 복제가 있다. 이 연구에서는 이 3가지 요건의 주체와 기준에 대해 분석하고, 미국, 영국, 일본, 호주의 저작권법에서 규정하는 도서관 등에서의 복제에 관해 비교 ․ 분석하였다. 우리 저작권법 제31조 제1항은 일본 저작권법 제31조 제1항과 매우 비슷하다. 그러나 우리나라와 일본의 도서관 환경은 매우 다르므로 우리나라 저작권법은 일본과는 다른 기준을 두어서 분석해야 한다. 영국과 호주는 저작권법이 비슷하고, 미국은 다르다. 현재 우리나라 저작권법 31조에서 이용자의 요구가 어디까지인지, 일부분의 복제나, 보존용 자료의 부수, 디지털 형태로의 복제, 절판 그 밖의 사유로 구하기 어려운 도서 등이라는 기준을 외국 저작권법과 비교하여 그 기준과 범위가 어디까지이며, 외국 저작권법 조문 중 어느 조문을 받아들일지 아닐지를 비교 분석하였다.

Copyright law refers to a protective right of economical profits generated from the use of copyright works. However, in case of satisfying certain conditions, the liberal use of copyright works is allowed. These are the reasons of copyright law limitation. Among them, the reproduction of copyright works by libraries and others is allowed by the article 31 of the copyright law. With this permissive article of reproduction by libraries and others, documents, records and some other data, which are owned by libraries and others, can be reproduced. At this time, the copyright law prescribes three conditions: (1) the reproduction by the requirement of users; (2) the reproduction for the preservation of books and so on themselves; and (3) the reproduction for the preservation of books and so on, which are difficult to be obtained, by the requirement of other libraries and so on. In this study, the main subjects and criteria of these three conditions were examined. In addition, these three conditions were comparatively analyzed with the reproduction by libraries and others, prescribed by the copyright law in such countries as the United States, the United Kingdom, Japan and Australia. The section 1 of article 31 of the Korean copyright law is very similar to the section 1 of article 31 of Japanese copyright law. But since the environment of Korean library is quite different from that of Japan, the Korean copyright law must be examined with different criteria. The United Kingdom and Australia are similar in their copyright law, but the United States is different from them. Therefore, in this study, the extent of user requirement prescribed in the article 31 of the Korean copyright law was examined. And comparing to the copyright law of other countries, the criteria and scopes of partial reproduction, number of copies for preservation data, and books which were difficult to be obtained by the cause of out-of-print and so on were looked into. In addition, the investigator examined whether certain articles of foreign Acts articles were introduced into Korea or not.
