2021년 전부개정 지방자치법은 자치분권2.0시대의 개막을 의미하는가?

Abstract

본 연구는 1988년 지방자치법 전부개정 이후 2021년 지방자치법 전부개정까지 32년간의 지방자치법의 개정 내용을 각 조문별로 분석하여 이번 지방자치법 전부개정이 지금까지의 지방자치법 개정과 어떠한 차이점을 갖고 있는지를 살펴봄으로써, 이번 전부개정이 과거와 다른 근본적인 차이를 갖고 있는지를 따져보고, 자치분권 2.0 시대의 패러다임의 기준에 비추어 과연 이번 전부개정이 정부가 주장하는 바와 같이 지방자치 1.0 시대에서 자치분권 2.0 시대로의 패러다임 전환에 해당하는지를 평가하고자 하였다. 분석 결과, 2021년 지방자치법 전부개정법률은 1988년 지방자치법 전부개정 이후 가장 큰 폭의 제도 변화의 내용을 담고 있는 것은 분명하고 개정의 양적인 측면에서도 이전의 일련의 지방자치법 개정과 많은 차이가 발견되고 제도 변화의 질적인 측면에서도 이전의 제도와 차별화되는 내용이 많이 있다고 할 수 있으나, 중앙과 지방 간 정부간 관계의 전환과 단체자치에서 주민자치로의 전환이라는 지방자치의 새로운 패러다임을 제시하고 자치분권 2.0 시대를 열었는지에 대해서는 부정적인 평가를 할 수밖에 없다. 다만, 이번 전부개정에서 지방자치의 다양성 확대라는 측면에서는 지금까지의 획일적 지방자치의 틀을 획기적으로 전환시킬 수 있는 중요한 계기를 만들어 주었다는 점에서 큰 의미가 있다고 할 수 있다.

This study analyzes the contents of the amendments to the Local Autonomy Act for 32 years since the 1988 fully amended Local Autonomy Act revision to the 2021 fully amended Local Autonomy Act by each article, and examines the difference between 2021 Local Autonomy Act revision and the previous Local Autonomy Act revisions. By examining whether 2021 revision has any fundamental differences from the past revisions, this study aims to evaluate whether 2021 fully amended Local Autonomy Act corresponds to a paradigm shift from the 1.0 era of local autonomy to the 2.0 era of autonomy and decentralization, as the government claims. As a result of the analysis, it is clear that the 2021 fully amended Local Autonomy Act contains the largest institutional change since the 1988 fully amended Local Autonomy Act, and there are many differences from the previous series of Local Autonomy Act amendments in terms of the quantity of the amendment and the quality of the system change. However, there is no choice but to give a negative evaluation as to whether the 2.0 era of autonomy and decentralization has opened through the change of intergovernmental relations and the change from institutional autonomy and citizen’s autonomy. Despite this limit, expanding the diversity of local autonomy in the Act is meaningful in that it creates an important opportunity to make an essential change to the framework of uniform local autonomy.
