혐오범죄의 유형 -한국과 미국의 혐오범죄 사건을 중심으로 -

Abstract

혐오범죄는 단순하게 누군가를 싫어해서 범죄를 저지르는 것이 아니다. 사회적으로 힘이 있는 집단들이 자신들의 이익을 위하여 사회적으로 약한 사람들을 특정하여 범행함으로써 억압을 함으로써 이득을 취하는 것이다. 그러므로 혐오범죄를 개인 간의 싸움으로 보아서는 안 되고 사회적인 문제로 바라보아야 한다. 혐오범죄의 유형으로는 비교혐오와 신념혐오로 구분할 수 있다. 비교혐오는 사회적 으로 힘 있는 집단들이 자신들의 우월성과 상대방의 열등성 확보를 위한 수단으로 사용한다. 상대방과 비교를 통하여 혐오범죄를 저지르다 보니 주로 가시적으로 특징이 뚜렷한 특징을 가진 집단원들이 표적 대상이 된다. 신념혐오는 혐오 선동자들이 표적한 대상을 사회의 절대적인 악이라고 주장하며 혐오 받아 마땅한 사람들이라는 주장을 한다. 자신들이 절대적인 정의이고 상대방들이 절대적인 악이라는 믿음을 가진 혐오 선동자들의 특징 때문에 신념혐오 범죄가 발생할 경우에는 아주 심각한 피해를 입히기 위해 노력하는 범죄의 형태를 볼 수 있다. 앞으로의 한국 사회는 다양한 출신 국가의 사람들이 많이 유입되고, 개인의 특성을 중요시 생각하는 사회로 지속적으로 변해가고 있는 만큼 다양한 가치관을 가진 집단들이 많아질 것이 예견되어 있다. 국가 구성원들의 집단이 다양해진다는 것은 나와 다른 특징을 가진 사람들이 늘어나게 된다는 것이며, 이는 곧 각자의 집단 간의 충돌이 높아지는 현상이 발생하는 결과를 낳는다는 의미를 갖는다. 다시 말하자면 혐오의 대상과 종류가 더욱 다양해지고 세부적으로 발전할 것이며, 혐오범죄가 증가할 수밖에 없는 사회적 변화가 이미 진행되고 있다는 것이다. 혐오범죄는 이미 우리의 일상에 있으며, 앞으로는 더욱 심각한 문제를 야기하게 될 것이다. 그러므로 우리는 앞으로 혐오범죄에 대하여 충분한 이해가 요구되며, 사회적인 관심과 제도 마련이 필요하다.

Disgusting crime is not committing a crime simply because you hate someone. Socially powerful groups benefit by suppressing socially vulnerable people by specifying and committing crimes for their own benefit. Therefore, hate crimes should not be viewed as a fight between individuals, but as a social problem. The types of hate crimes can be divided into comparative and belief hatred. Comparative hate is used by socially powerful groups as a means to secure their superiority and inferiority of the other party. As hate crimes are committed through comparison with the other party, group members with visible characteristics are mainly targeted. The hate of faith claims that the object targeted by the hate agitators is the absolute evil of society and claims that they deserve to be hated. Because of the characteristics of hate instigators who believe that they are absolute justice and that the other is absolute evil, we can see a form of crime that tries to cause very serious damage in the event of a hate crime. In the future, Korean society is expected to have more groups of various values as many people from various countries are flowing in and continue to change into a society that values individual characteristics. The diversification of the groups of state members means that the number of people with different characteristics will increase, which means that the conflict between each group will increase. In other words, the object and type of hate will be more diverse and develop in detail, and social changes are already underway, which will inevitably increase hate crimes. Hate crimes are already in our daily lives, and they will cause more serious problems in the future. Therefore, we need a full understanding of hate crimes in the future, and we need to prepare social attention and institutions.
