미국 건국 초기 연합의회와 연방의회의 비교

Abstract

전국적 입법기관이 국가의 최고권력기구로 통했던 건국 당시에 13개 주간의 협의체 역할을 했던 연합의회와 연방의회는 권력의 집중을 혐오하며 분권화된 체제를 유지하고자 했던 미국 건국초기의 분위기를 반영하면서 각각 당대의 중앙정부로서 기능하였다. 그러나 연합의회는 연합의회를 구성하고 있던 주정부의 독립성으로 인하여 실질적이며 효과적인 거버넌스에 실패하였다. 연합의회 의원의 임기와 선발은 주정부의 의사에 좌우되었으며, 연합의회는 자신이 제정한 법률을 각 주에 강제할 권한도 부여받지 못하고 있었다. 독립성과 제도화의 수준이 현저히 낮았던 연합의회는 주간의 교역 및 어로분쟁, 전시부채의 지급문제, 대외적인 국방문제 등을 해결하지 못한 채 표류하면서 결국 보다 강력한 중앙정부의 필요성만 부각시키게 되었다. 연합헌장체제하의 연합의회가 무능하다는 문제와 함께 새로운 헌법과 국가기관을 설립을 위해 1787년 소집된 필라델피아 헌법회의는 연방헌법과 함께 국가최고 권력기관으로 연방의회를 창설하면서 보다 중앙집권화된 형태의 연방정부의 등장에 공헌하였다. 제정된법률이 인민과 주에 대해서 직접적인 구속력을 지니게 된 연방의회는 조세권과 통상규제권을 추가적으로 확보하면서 국가연합체제를 넘어서는 연방의 권력기관으로 자리매김할 수 있었다. 또한 연방의회 의원들은 양원제하에서 고정된 임기를 보장받고 임기제한에 구속되지 않은 채 보다 독립된 지위를 확보하며 의정활동을 영위할 수 있었다. 따라서 주정부 중심의 원심력에 의해서 좌초되지 않을 수 있었던 연방의회는 이후 19세기를 거치면서 제도화의 수준을 제고하고 전문성을 확보하면서 보다 강력한 국가기관으로 성장할 수 있었다.

During the early phase of the newly-born American Republic, the legislature of a national scale was granted the status of supremacy, because legislative power, rather than executive power, was considered as the highest power and because the national legislature was thought to be the only plural governing organization not violating state sovereignty. The Confederation Congress as too plural an organization to be called a “government,” however, was not able to command a proper level of obedience from the state governments, since it was not able to decide on its own terms. The delegates were bound by the state governments’ instructions; they were selected and recalled by the state legislatures; their terms of office were limited; the Congress itself was not able to impose the laws made within it. On the contrary, the Federal Congress, established by the Federal Constitution adopted in 1787 at the Philadelphia Convention, was granted the status of the national supreme political organization. It was able to impose its decisions on both individual states and their residents. The members of both the House of Representatives and the Senate were not easily removed by the state government, and thus were able to work without worrying about the recall by the state government. Their terms of office were unlimited, and their salary was paid from federal treasury. Created and developed in this way, the Federal Congress was able to work as a supreme legislative organization, keeping the executive in balance and developing its own expertise.
