코로나19 팬데믹으로 인한 행정의 계획(결정) 및 허가(결정)절차에 있어서 대중참여의 새로운 경향 및 시사점: 독일 계획안정화법률의 분석을 중심으로

Abstract

로나19 팬데믹 사태로 법질서는 물론 공동체가 놓인 환경과 현실이 예상할 수 없을 정도로 급격하게 변하였고, 계속적으로 변하고 있다. 이런 예기치 못한 재난상황은 다양한 행정결정들의 계획 및 허가절차에 있어서 대중참여라는 절차요소를 이를 주관하는 행정청들로 하여금 새로운 도전에 놓이게 한다. 무엇보다 행정결정들의 계획 및 허가절차들에 있어서 대중참여는 일반적으로 사람들간의 일정 공간에서의 직접적 만남 내지 공존 (Zusammentreffen)을 통해 현실화되었는데, 사회적 거리두기 내지는 사람들간의 접촉을 제한하고 있는 현재의 재난 상황에서는 기존의 틀을 고수할 수 없게 되었다. 이러한 난관을 극복하고 행정결정의 법적안정성을 확고히하고자, 독일 연방 입법자들은 위기시기입법(Krisengesetzgebung)의 하나로 2020년 5월 계획안정화법률 (Plansicherstellungsgesetz)을 제정하였다. 무엇보다 이 법률의 관심사는 코로나 19 팬데믹의 심각한 상황하에서 -이에 상응하는 계획과 허가절차에서 법적으로 대중의 안정적인 참여를 위한-절차를 완화(verfahrenserleichternd)하는 디지털 형태의 참여방식을 준비하기 위한 것이다. 현행 「행정절차법」, 「국토의 계획 및 이용에 관한 법률」, 「전원개발촉진법」 등등 우리 실정법상 행정결정(작용)절차에 대한 대중참여의 규정은 어디까지나 코로나 감염병같은 재난상황이 없는 통상의 사례를 기반으로 하여 명문화한 것이다. 기본적으로 사람들간의 모임 내지 어떤 거소에 실제적으로 존재함을 통해 참여가 현실화다는 사실을 고려하면, 사람들간의 접촉제한과 거리두기 조치가 계속되고 있는 현 상황에 대처하기 위한 행정결정과정에 있어서의 대중참여의 법제적 개선이 필요하다.

The study deals with an analysis on the current developments due to the Covid 19 panemic in public participation in the administrative process, in particular on the Plan Security Act (PlanSiG). More recently, we continue to face the Corona pandemic risks. They are putting current legal order and state in a first-time dysfunction. This Covid-19 pandemic poses new challenges for the administration, especially with regard to public participation in the planning and approval process. Traditionally, public participation in administrative procedures is usually realized through physical or bodily presence at the site. However, this classical and traditional method of participation is confronted with change due to contact restrictions and physical distance in the pandemic. Against this background, the federal legislature intends to solve the problem of public participation in the administrative process under the spread of the pandemic with a temporary PlanSiG that came into effect on May 29, 2020. This example gives the reasonable incentive for our administrative procedure concept, especially public participation concept in administrative procedure.
