지식재산 보호 방법의 결정요인에 관한 연구

Abstract

이 연구는 과학기술정책연구원의 KIS(Korean Innovation Survey) 2016 설문조사 자료를 활용하여 전유성 확대를 위한 기업의 기술혁신을 보호할 방법의 결정요인을 비교 분석하여 기업의 특성과 산업의 특징에 따른 전유제도에 관한 시사점을 논의하였다. 기업의 전유성 확대를 위한 IP 보호 방법의 결정요인을 분석하기 위해 기업이 각각의 보호 방법을 직접 평가한 점수를 순위 프로빗(probit) 모형을 적용하여 실증 분석하였다.산업별 IP 보호 방법에 대한 중요성 평가점수는 전체적으로 지식재산권의 평가점수가 가장 높게 나타나고 시장선점, 사내기밀, 복잡설계 방법 등 평가점수순으로 나타나고 있으며, 기업 지식재산권의 평가 중요도에 미치는영향은 기업 규모에 따라 결과가 달리 나타나고 있다. 대기업의 IP 보호 방법 평가는 혁신의 신규성 범위를 나타내는 최초 출시 신제품 여부만이 지식재산권 평가에 긍정적인 영향을 미치는 것으로 나타났다. 중소기업의 지식재산권 중요성 평가는 시장 최초 신제품 출시 여부와 혁신의 신규성 정도를 나타내는 점진적 기술혁신 여부가중요한 요인으로 작용하는 것으로 분석되었다.기술혁신 수준의 경우 혁신 유형과 상관없이 모든 기업 규모에서 하이텍산업의 기업은 모든 IP 보호 방법에영향을 미치고 있으나, 중간기술산업, 중저기술산업 및 저기술산업에서는 대기업을 제외한 모든 기업의 IP 보호방법의 중요성 평가에 영향을 미치고 있다. 특히, 혁신 유형과 상관없이, 하이텍기업은 모든 IP 보호 방법의 평가에 영향을 미치고 있다는 것은 하이텍 기업의 IP 보호 방법을 촉진하는 정책적 지원이 필요함을 시사한다.

This paper empirically examines to determine the subjective importance of the IPRs and strategic IP protection methods using STEPI’s 2016 Korean Innovation Survey data base. The empirical results are summarized as followings. First, among IP protection methods, firms rate IPRs as more valuable than strategic IP protection methods. Next, ordered Probit regressions show that the probability that a firm rates IPRs as more valuable than strategic protection methods varies with firm size, firm and industry characteristics. Large and small firms rate IPRs as more valuable than strategic IP protections. However, innobiz and venture companies regarded the IPR more important than strategic protections.Finally, levels of technology in industries can also affect the importance of selecting IP protection methods.Specially, high tech companies rates IPRs including patents as more valuable than strategic protection. The results are relevant to debates over changes to the patent system and the need for policies to encourage small firms to patent more.
