Abstract
Newspapers must report the report materials the most fast, accurately and honestly without any prejudices. This role definition for newspapers is also applied to Korean sports newspapers assume the helm of sports industry in Korea. However, the current reports and materials of Korean sports newspapers makes the readers doubt the role of sports newspapers for the illegalities and even its immoralities. With this reason, this research aimed to define the kinds of illegal inclusions of Korean sports newspapers, adopt the Korean positive laws on the each kind to prove the illegality and interpret the results and propose several suggestions. The research results are as follows: First, the Korean sports newspapers could be defined with fake news, exaggerated journal type advertisements and lewd or provocative advertisements or journals. Second, fake news is violated the #21 of Korean Constitutions, #2 of Korean Civil Law and #347 of Korean Criminal Law. Third, the violated Korean newspapers have a civil responsibility, such as liability for damages or other types civil responsibility, based on #2 and #750 of Korean Civil Law and #1 and #3 of The Expression and Advertisements Acts of Korea to the victims. With the #347 of Korean Criminal Law, the Korean newspapers would be punished like fine or other types of penalty Fourth, when #347 of Korean Criminal Law and #21 of Korean Constitutions are at odds, the decisions should be based on the purposes of the inclusions. In the end of this research, several suggestions were proposed to prevent recurrences.
