主権的秩序をめぐる二つの法理 - 帝国日本のインターナショナリズムとその技法(1) -

Abstract

This paper aims to explain the historical significance of a controversy on the essence of the law between Minobe Tatsukichi and Yokota Kisaburo. Three points will be demonstrated throughout my analysis. (1) Their theory was under the influence of Georg Jellinek and Hans Kelsen severally ; (2) Minobe and Yokota were internationalists together ; (3) For a purpose to let internationalism establish in empire Japan, Their controversy was caused as "divergence of the method". 본고에서는 미노베 다쓰키치(美濃部達吉)(헌법학)와 요코타 기사부로(横田喜三郎)(국제법학)의 논쟁을 명확히 하고자 한다. 본고의 분석을 통하여 다음을 명확히 하였다. (1) 두 학설이 옐리네크와 켈젠의 형양을받았다는 점, (2) 양측 모두 국제주의자였다는 점, (3) 양측의 논쟁이 제국 일본에 있어 국제주의를 성립시키기 위한 '방법의 분기'의 결과 발생하였다는 점.
