- Abstract
- 유럽연합의 ‘소비자분쟁의 대체적 분쟁해결에 관한 지침’이 지난 2013년 채택되고 그에 따라 독일은 2016년 ‘소비자문제에 대체적분쟁해결법(Gesetz über die alternative Streitbeilegung in Verbrauchersachen)’을 제정하고 시행하기에 이르렀다. 이 법에서는 독일내에서의 민간조정기관의 설립 및 승인 그리고 조정기관의 운영에 관한 사항이 자세히 규정되어 있으며, 분쟁해결절차의 진행에 필요한 세부적인 사항들이 적확하게 규정되어 있다. 이 법에 규정된 내용은 소비자문제에서 대체적 분쟁해결방법의 활성화를 통해 손쉽게 분쟁을 해결하고자 하는 우리의 제도적인 발전방향에 모범이 될 수 있는 자료로 활용가치가 있다고 할 수 있다.
