한국 혼합대통령제에서 책임총리제의 특징과 한계 －행정부 운영 분담 시스템으로서의 노무현 정부 책임총리제의 구성과 운영

Abstract

책임총리제를 보다 명확히 이해하기 위해서는 헌법적 규범으로서의 정치제도와 이것이 포함하고 있는 여러 제도들의 정확한 기능, 혹은 제도적 관행에 따른 정치시스템을 구분하는 관점이 유용하다. 한국의 대통령제는 이원정부적 요소인 국무총리제를 채택한 혼합대통령제로서 대통령과 국무총리의 관계에 따라 상이한 정치시스템이 나타날 잠재성을 가지고 있다. 이 잠재성을 실현한 노무현 정부의 책임총리제는 국무총리에게 당파적 정부수반의 역할을부여하고 내치에 있어 정책조정권을 위임함으로써 국무총리의 역할과 권한을 극대화하여 외관상 이원정부제의 단점정부와 유사하게 작동되었다. 그러나 권력구조의 한계, 집권당 리더십, 국무총리의 역할과 권한의 제도화 수준, 그리고인적 결합의 특성을 감안할 때 책임총리제는 이원정부제의 양두 시스템과는 본질적인 차이가 있으며 한국의 혼합대통령제에 나타날 수 있는 행정부 운영 분담 시스템으로 정의될 수 있다.

With some viewpoint, ‘responsible prime minister system’ of Rho Government is regarded as dual system of semi-presidential executive or only a result of President Rho’s leadership. But to understand more correctly about that, it need to consider the characteristics and limits of the korean presidential regime and practice of that in the view of distinguishing between a constitutional regime and a political system which lies behind the function or practice of regime. Although Korean mixed presidential regime has the prime minister that is typical of semi-presidential system, it is fundamentally presidential regime; president always was placed above prime minister and korean prime minister’s role and power is within the bounds of president’s delegation. In this viewpoint, a responsible prime minister system of Korea is not a dual system of semi-presidential executive but the function-partaking system of executive of the Korean mixed presidential regime.
