조선시대 養子의 한 풍경 -채팽윤의 한시를 중심으로-

Abstract

조선시대 養子를 들이는 것은 매우 빈번한 일이었다. 통상 家系의 단절로 아들이 없거나[無後], 딸만 있거나[無男], 아들이 있긴 하지만 적자가 아닌 경우[無嫡子]로 나눌 수 있다. 養子가 된다는 것은 여러 가지 복잡한 절차를 거쳐서 정해진다. 그로 인해 법률적이나 정서적인 여러 문제가 발생할 여지가 많았다. 지금까지 양자에 관한 연구는 주로 역사 분야에서 진행되어 왔고, 문학 작품을 통한 연구는 거의 없었다. 조선시대 養父와 養子의 실제 모습을 볼 수 있는 자료는 많지 않다. 채팽윤은 그의 문집에 자신의 양자인 채응동에 대하여 50여 수의 시를 남겼다. 이 자료를 통해 조선시대 양자의 한 모습을 생생히 엿볼 수 있었다. 우선 양자에 관한 결정과 경위를 살펴보았다. 양자를 결정하는 일은 정서적이거나 법률적인 문제가 복잡하게 발생할 여지가 많았다. 본인이 입양을 결정했다고 하더라도, 어떤 사람의 몇 번째 아들을 어떤 시점에 어떤 방식을 통해야 하는지가 여전히 해결해야 할 숙제였다. 채팽윤의 시문에는 입양 결정과 경위가 소상히 나와서 조선시대 입양과정을 생생하게 파악할 수 있다. 다음으로 養育에서 느끼는 일상의 기쁨을 담고 있다. 양육에 대한 간절한 희망이 현실로 바뀌는 놀라운 체험은 그 자체로 기쁜 일이었다. 아이와의 逸話를 통해서 상세하게 그려냈다. 아이에 대해 애틋하고 따스한 감정도 주저없이 표현하고 있다. 채팽윤의 아이에 대한 태도는 엄격하기보다는 자애롭다. 주변 사람들이 아이의 訓育을 강도 높게 주문했지만, 채팽윤은 나름의 교육 철학을 가지고 본인의 방식대로 아이를 훈육했다. 끝으로는 본인과 아이의 상황에 따라 떨어져 있게 되는 상황에서의 슬픔과 그리움을 적고 있다. 부모와 자식 모두에게 離乳란 어려운 과정이다. 서로의 상황에 따라 떨어져 있으면서 서로를 그리워하며 부자의 정을 키워간다. 이러한 시들이 가장 큰 비중을 차지하고 있다. 기르는 정과 키우는 정 중에서 어느 것이 더 절실할까? 피로 맺어져 있는 血肉의 감정은 근원적이면서 원초적이다. 그러나 가족은 서로의 유전자를 공유하여 태어나면서 시작되기는 하지만, 서로의 시간과 생활을 공유하면서 만들어지기도 한다. 가족이란 결국 함께 지나온 시간의 퇴적물에 다름 아니다. 채팽윤이 養子에게 남긴 시를 통해서 이 시대에 가족에 대한 의미를 다시 한번 환기할 수 있게 되기를 바란다.

During the Joseon Dynasty, adopt children was a frequent customary practice. Usually, a measure against the disconnection of the family, cases of adoptions couldbe divided into cases where there was no son, where there was only a daughter, or where there was a son, who was not deemed appropriate. Adoption was determined through a number of complex procedures. As a result, there was a lot of room for legal and emotional problems. Until now, research on adoption has been mainly conducted in the field of history, and few studies have been conducted based on literary works. There are few materials that represent the actual experiences of yangbu and yangja during the Joseon Dynasty. Chae Paeng-yoon left about 50 poems about his adopted son, Chae Eung-dong, in his collection of writings. Through these texts, we can gain a vivid glimpse of adoptees in the Joseon Dynasty. First, this study examined the decisions and circumstances of adoption. Determining adoption presented a lot of potential for emotional or legal problems to arise. Even when adoption was decided, it remained challenging to solve question such as at what point to adopt and which of someone‘s sons should be adopted. Chae Paeng-yoon's poetry contains detailed descriptions of adoption decisions, presenting a vivid documentation of the adoption process in the Joseon Dynasty. Next, the poetry contains the joy of daily life felt in parenting. The amazing experience of turning the desperate hope for parenting into reality is portrayed in the text as a pleasure in itself. This experience was drawn in detail through an anecdote with a child. The poet also expresses his affectionate and warm feelings for the child without hesitation. Chae Paeng-yoon's attitude toward the child is benevolent rather than strict. People around him strongly urged a strict approach to the child's rearing, but Chae Paeng-yoon disciplined the child in his own way with his own educational philosophy. In the end, the poet portrays the sadness and longing in a situation where he and the child are separated due to circumstances. It is a difficult process to weave both parents and children. Depending on each other's situation, they are separated, miss each other, and develop rich affection. These poems occupy the largest proportion. Which is more significant? The affection of growing or that of raising? The emotions that arise from the bonds of blood are fundamental and primal. However, although families may begin through the birth of a child sharing common genetic ties, they are also created by sharing habits and lives with each other. In the end, a family is defined by the sediment of time that has passed together. This study reflects the hope that the poetry left by Chae Paeng-yoon will be able to recall the deeper meaning of familial love once again in this era.
