정신장애인의 자기결정권 존중을 위한 제도 도입: 정신건강 전문가와 소비자의 인식을 중심으로

Abstract

인권 패러다임을 지향하는 정신건강복지법 전면 개정에 따라 자기결정권 존중을 위한 서비스 체계 구축은 정신건강 영역에서 풀어야 할 중요한 과업 중 하나가 되었다. 하지만 아직까지 자기결정권은 추상적 선언에만 머물고 있을 뿐 구체적인 제도 도입에 대한 논의는 부족하다. 이에 본 연구는 (1) CRPD, QualityRights, 해외 사례 등의 문헌검토를 통해 자기결정권 존중을 위한 구체적 제도를 파악하고, (2) 파악된 제도에 대한 설문조사를 통해 293명의 전문가 및 소비자들이 인식하는 인지도, 중요도, 시급도를 중심으로 정책우선순위를 파악함으로써, 제도 구축을 위한 함의를 도출하고자 하였다. 문헌검토 결과, 자기결정권 존중을 위한 제도로 지원자 제도, 절차보조, 사전의향서, 오픈다이얼로그, 강제입원 폐지, 좋은 정신과 진료, 함께하는 의사결정, 전문가대상 QR교육, 지역사회 서비스 체계, 개별서비스 지원체계, 지원주택 및 지원고용, 위기쉼터, 동료지원, 당사자운영 서비스, 당사자 정책참여, 권익옹호기관 등 총 16개 제도가 파악되었다. 설문조사 결과, 파악된 16개 제도에 대한 인지도는 전문가 집단이 소비자 집단에 비해 대체로 높은 것으로 나타났고, 16개 제도에 대한 중요도 인식은 두 집단 간 유사하였으며, 시급도에 대한 인식은 대체로 유사하였지만 당사자의 서비스 및 정책참여에 대한 인식에 있어 소비자 집단이 전문가 집단에 비해 높은 것으로 나타났다. 정책의 우선순위는 지역사회 기반구축과 당사자 참여 관련 제도들이 상대적으로 높게 나타났다. 이러한 결과를 바탕으로 우리나라 정신장애인 자기결정권 존중 제도 구축을 위한 함의를 논의하였다.

After the full revision of the Mental Health Welfare Act that is based on the human rights paradigm, the development of a self-decision making support system has become one of the most imperative tasks to be solved in the delivery system of mental health service in South Korea. Regardless of the government’s declarations of developing relevant systems, discussions on specifics are still insufficient. Therefore, this study aims to derive implications for establishing the system by (1) identifying specific self-decision making support systems through literature reviews involving the Convention on the Rights of Persons with Disabilities(CRPD), QualityRights, and overseas cases, and by (2) identifying policy priorities through a survey on stakeholders’ perceptions on the identified systems in terms of awareness, necessity, and urgency involving 293 stakeholders. As a result of the literature review, a total of 16 systems were identified: supporter, procedure-assistance, psychiatric advanced directives, open-dialog, abolishing compulsory hospitalization, good psychiatric practice, shared decision-making, QualityRights(QR) education for professionals, community service system, individualized service system, supported housing and supported employment, crisis shelter, peer support, consumer-run services, consumer policy participation, and advocacy organization. As a result of the survey, the awareness of the 16 systems identified was generally higher among the professionals than consumers, the importance of awareness was similar between the two groups, and the perception of urgency was generally similar, but the perception of consumers was higher than that of professionals. The policy priority was relatively high in establishing community service systems and enhancing consumer participation. Based on these results, implications for establishing a self-decision making support system were discussed.
