국민참여재판 배심원 선정절차의 개선방안

Abstract

국민참여재판은 국민의 참여로 판사와 검사의 자의적인 사법권 행사를 통제함으로써 국민의 사법 불신을 해소하고 사법의 민주적 정당성과 신뢰를 제고하기 위하여 도입되었고, 10여년 간의 운영 결과 긍정적으로 평가되고 있기는 하나, 그 실시율이 전체 형사사건에 대비하여 소수에 불과하고, 실제 운영에 있어서도 많은 시간적･경제적 부담이 있으며, 배심원에 의한 결론의 비합리성에 대한 우려가 여전히 존재한다. 사법의 민주화를 위하여 어렵게 도입된 국민참여재판 제도가 형해화되지 않도록 하기 위하여는 국민들이 배심원으로서 적극적이고 실질적인 참여가 이루어지도록 하면서도, 제도 운영에 있어서의 시간적･경제적 부담을 최소화하고, 비합리적인 결론 도출 가능성을 최소화하는 방향으로 운영될 수 있도록 하는 개선방안이 매우 필요하다. 이를 위하여는 공정한 사법제도로서의 기능을 구현할 수 있는 기초로서 공정하고 편견 없는 배심원을 선정하는 것이 무엇보다도 중요한바, 그 개선방안으로 배심원후보예정자 선정 단계에서부터 대표성, 다양성, 전문성을 갖춘 후보자를 선정할 수 있는 절차를 마련하고, 배심원 선정 단계에서도 공정한 배심원이 선정될 수 있는 질문절차 및 기피신청 절차를 마련할 필요가 있다. 또한 시간적･경제적 부담 문제의 개선을 위하여 배심원(후보자) 수 및 질문의 표준화를 통한 선정기일 소요시간의 개선 절차 또한 필요하다.

Citizen Participation in Criminal Trials was introduced to increase the democratic legitimacy and credibility of jurisdiction, and the results of its operation for over 10 years have been positively evaluated. However, the rate of implementation is limited to a small fraction in light of the entire criminal case, and there are also time and economic burdens in the actual operation, in addition to concerns about the irrationality of the jury's conclusion. In order to revitalize this system, which was initially introduced with difficulty for judicial democratization, active and practical participation of the Citizen is required, and it is also very necessary to improve the system so that it is operated in a way that minimizes the time and economic burdens as well as the possibility of unreasonable conclusions. To this end, it is of utmost importance to select a fair and unbiased jury as a basis for realizing the function of a fair judicial system. As for improvement measures, first, it is necessary to prepare a procedure to select candidates with representativeness, diversity, and expertise during the stage of selecting prospective jurors. A standardized questioning procedure should be put in place to ensure fairness in the jury selection stage, and third, improvement procedures is needed to solve the problem of time and economic burdens.
