한-EU FTA에서의 지리적 표시 보호제도 개선에 대한 연구

Abstract

한-EU FTA는 지리적 표시의 리스트 교환방식에 의한 간편보호체제를 채택하고 있고 양 당사국의 합의에 따라 ‘보호 지리적 표시’목록을 추가할 수 있도록 정하고 있다. 한-EU FTA 체결 후 처음으로 부속서 개정을 통하여 EU의 46개 지리적 표시가 추가로 보호될 예정이다. 한-EU FTA의 경우 지리적 표시 의제는 협상 과정 내내 합의 도출이 어려웠던 분야였다. EU측은 EU 회원국에 등록되어 있는 모든 지리적 표시의 보호를 요구하였지만, 협정문 부속서 제10-가 농산물 및 식품에 대한 지리적 표시와 제10-나 포도주, 방향포도주 및 증류주에 대한 지리적 표시 목록에 등재된 것만을 우선적으로 보호하기로 합의를 하였다. 한-EU FTA가 채택하고 있는 ‘보호 지리적 표시’의 리스트 교환 및 추가 방식은 FTA 협상에서 지리적 표시 의제가 되는 경우가 많다. 그런데 2019년 2월 1일 발효된 일-EU EPA는 지리적 표시 보호 방식은 한-EU FTA와 동일한 방식을 채택하고 있지만, 보호범위, 적용제외 등 미세한 점에서 차이가 존재한다. 본 논문은 한-EU FTA와 일-EU EPA의 지리적 표시 조항을 분석한 후, 한-EU FTA 개선(GI 분야)시 반영되어야할 필요한 의제도출을 검토하고자 한다. 특히, 한-EU FTA와 일-EU EPA의 비교‧분석을 통하여 한-EU FTA 규정 중 우리 측에 지나치게 불리한 조항을 발굴하여 한-EU FTA 개선 협상시 제안할 사항을 검토한다. 또한 본 논문은 한-EU FTA 제10.24에서 규정하고 있는 부속서 개정을 통한 지리적 표시의 추가보호 절차는 실질적인 한-EU FTA의 개정사항에 해당하므로 국회 비준이 필요한 사항에 해당하는 것인지에 대한 문제에 대해서도 검토한다.

On 1 July 2011, the Korea-EU Free Trade Agreement (Kor-EU FTA) entered into force. Building on WTO Agreement on Trade-Related Aspects of Intellectual Property Rights (the TRIPS Agreement) Agreement, the Kor-EU FTA provides for the protection of individual geographical indications (GIs) for agricultural products and foodstuffs listed in its Annex 10-A comparable to the level of the additional protection stipulated in the TRIPS Agreement. The list may be extended to other products in future if the EU and Korea agree. However, Such TRIPS-plus approach gives more benefits to the EU side and pose implementation challenges to the Korean side including the extension of the original list of GIs. The purpose of this paper is to survey provisions concerning GIs in the Kor-EU FTA and to highlight how these provisions compare with GIs provisions under the Japan-EU Economic Partnership Agreement and the multilateral trading system as embodied in the TRIPS Agreement. Furthermore the paper focuses on some specific issues about the extension of the original list of GIs and renegotiation strategies for the implementation/improvenment of the Kor-EU FTA.
