2019년 지적재산법 중요판례평석

Abstract

이 글은 지적재산법과 관련하여 2019년에 선고된 대법원 판결들 중 중요하다고 생각되는 것을 선정하여 검토한 것이다. 이 글은 전부 6개의 장으로 구성되어 있다. 제1장은 서론이고, 제2장은 특허법·실용신안법에 관한 것으로서 미완성 발명의 판단기준과 방법발명의 특허권 소진을 비롯한 9개의 판결들을 분석·검토한다. 제3장은 상표법에 관한 것으로서 권리 대 권리의 적극적 권리범위확인심판의 허용 여부를 비롯한 3개의 판결들을 분석·검토한다. 제4장은 부정경쟁방지법에 관한 것으로서 영업비밀에 관한 3개의 판결들을 분석·검토한다. 제5장은 저작권법에 관한 것으로서 온라인서비스제공자의 저작권 침해 방조를 비롯한 5개의 판결들을 분석·검토한다. 제6장은 결론이다.

The objective of this paper is to examine and review judgements concerning intellectual property law rendered by Korean Supreme Court in 2019. This paper is composed of six parts. Part I is introduction. Part II points out 9 problematic judgments including criteria for determining the incomplete invention, patent exhaustion of method invention etc. Part III reviews the judgments associated with 3 cases including trial for confirmation of scope of claims etc. Part IV reviews the judgments regarding 3 cases of the protection of a trade secret. Part V examines 5 cases including the secondary liability of online service provider etc. Part VI is conclusion.
