- Abstract
- 컴퓨터프로그램저작물은 특정한 결과를 얻기 위하여 컴퓨터 등 정보처리능력을 가진 장치 내에서 직접 또는 간접으로 사용되는 일련의 지시·명령으로 표현된 창작물을 말하며, 컴퓨터프로그램저작물의 보호는 특허법적 보호와 저작권법적 보호가 있을 수 있다. 우리나라는 저작권법의 특별법이라 볼 수 있는 컴퓨터프로그램보호법을 1986년 제정하여 컴퓨터프로그램을 보호하여 오다가, 2009년 저작권법을 개정하면서 저작권법에 흡수 통합하여 보호하고 있다. 이하에서는 소프트웨어 특성을 고려한 컴퓨터프로그램의 법적 보호 방안을 검토한 후, 현행 저작권법의 프로그램 관련 특칙과 법제도 개선 방안을 고찰하고자 한다.
