2021년 지적재산법 중요판례평석

Abstract

이 글은 지적재산법과 관련하여 2021년에 선고된 대법원 판결들 중 중요하다고 생각되는 것을 선정하여 평석한 것이다. 이 글은 전부 6개의 장으로 구성되어 있다. 제1장은 서론이다. 제2장에서는 특허법에 관한 8개의 판결들을 평석하였다. 제3장에서는 상표법에 관한 3개의 판결을 평석하였다. 그 중 주목할 판결은 후출원 등록상표 사용의 선출원 등록상표에 대한 침해 성립 여부에 관한 것이다. 이 판결은 전원합의체 판결로 앞으로 우리 상표 실무에 많은 영향을 미칠 것으로 예상되므로 그에 관한 체계적인 제도 개선이 이루어질 필요가 있다. 제4장에서는 부정경쟁방지법에 관한 1개의 판결을 평석하였다. 제5장에서는 저작권법에 관한 5개의 판결을 평석하였다. 그 중 주목할 판결은 이른바 리치사이트를 둘러싼 것으로 링크의 저작권 방조책임에 관한 것이다. 이 또한 전원합의체 판결로 앞으로 우리 재판실무에 많은 영향을 미칠 것이 예상된다. 제6장은 결론이다.

This paper is an analysis and review of important Supreme Court decisions in 2021 on Intellectual Property Law. This paper consists of a total of 6 chapters. Chapter 1 is an introduction. In Chapter 2, eight decisions on the patent law were analyzed and reviewed. In Chapter 3, three decisions on the trademark law were analyzed and reviewed. Among them, the notable decision is the case as to whether the use of a later-filed registered trademark infringes an earlier-filed registered trademark. This decision is the en banc decision, which will have a great influence on our trademark practice in the future. As a countermeasure against this, we need to systematically improve the trademark practice system. In Chapter 4, one decision on the unfair competition prevention law was analyzed and reviewed. In Chapter 5, five decisions on the copyright law were reviewed. Among them, the case concerning the criteria for determining the indirect copyright infringement by internet linking is important. It is also the en banc decision, which will have a great influence on our trial practice over so-called ‘leech site’.
