- Abstract
- 인간배아 줄기세포 수립을 계기로 그 연구와 연구성과물의 이용에 대한 기회와 위험에 대한 논의가 윤리적 관점에서 진행되고 있는 반면, 그 연구성과물의 특허성 인정여부도 관심이 집중되고 있다. 2006년 12월 5일 독일연방특허법원은 배아줄기세포(ES 세포: Embryonic Stem Cell)를 이용한 神經前驅細胞(Neurale Vorläuferzellen)에 관한 특허에 대하여, 인간에서 유래한 배아줄기세포에 관한 부분에 대하여 일부무효의 판결을 내림에 따라 세간의 많은 주목을 받고 있다. 본 논문은 인간배아줄기세포 관련 발명의 특허보호 가능성 및 윤리적 문제를 독일 연방법원특허법원 판례 및 관련 판례와 밀접한 관련이 있는 유럽의 입법동향을 살펴보고 우리나라에 있어서 특허법과 생명윤리와의 관계를 살펴보고자 한다.
