접근가능한 관광을 위한 지방자치단체의 관광약자 관련 조례분석

Abstract

이 연구는 접근가능한 관광관점에서 전국 지방자치단체에서 제정한 관광약자 조례의 내용분석을 통해서 문제점과 한계점을 도출하여 실효성 있는 조례의 발전 방향을 모색하였다. 분석 결과 관광약자 관련 조례는 대부분 유사한 내용 체계로 구성되었다. 관광약자의 범주는 장애인, 노인, 임산부, 영유아 동반자, 관광취약계층 등으로 나타났지만, 상위법률인 관광기본법과 관광진흥법내 규정은 장애인과 관광취약계층으로 한정하고 있어 추후 보완이 필요한 것으로 나타났다. 또한 관광약자를 위한 환경조성과 관련된 재정지원과 관련해서는 임의규정이 많고 권리성도 낮은 수준으로 나타나는 등 실제 관광약자의 관광향유권을 보장하고 지원에는 미흡한 것으로 나타났다. 이러한 분석 결과를 바탕으로 상위법률과의 정합성과 함께 제·개정될 조례의 발전 방향에 대해서 논의하였다.

This study is designed to explore the direction for the enhancement of effective ordinances from the perspective of accessible tourism. A content analysis of ordinances for the tourism weak class enacted by local governments of South Korea was conducted. As a result of the analysis, it was found that most of the contents of the ordinances related to the tourism weak class implemented across the country had a similar content. The scope of the tourism weak class was found to include the disabled, the elderly, pregnant women, those who accompany infants and young children, and the tourism vulnerable group. However, since the provisions of the Tourism Fundamental Act and the Tourism Promotion Act, which are upper laws, are limited to the disabled and the tourism vulnerable, further improvement is necessary. In addition, with regard to financial support related to the creation of the physical environment for the tourism weak, many arbitrary regulations exist and the right of tourism is found to be low. Based on these results, the development direction of the ordinance and the compatibility with the higher laws was discussed.
