메타버스와 국제사법 - 현재의 ‘메타버스’ 플랫폼을 중심으로 -

Abstract

차세대 인터넷을 위한 새로운 패러다임으로 지목되고 있는 메타버스에 관심이 집중되고, 관련 산업에 많은 투자가 이루어지고 있다. 이는 향후 메타버스상에서 분쟁이 급증할 수 있다는 것을 암시한다. 이에 본고에는 현재의 주요 ‘메타버스’ 플랫폼의 약관들과 ‘메타버스’ 플랫폼 관련 해외 사례들을 검토하여 메타버스 플랫폼을 중심으로 발생할 수 있는 국제 분쟁을 상정해보고, 국제재판관할과 준거법 결정 문제를 2022년에 개정된 현행 국제사법에 따라 검토해보았다. 그 결과 국제사법은 소비자계약, 지식재산권침해, 불법행위 소의 관할문제에 있어서는 메타버스와 같은 온라인 환경까지 염두에 두고 입법이 되었지만, 일반 계약의 소의 관할문제에 있어서는 그렇지 못하고, 특히 온라인 환경에서 발생하는 분쟁에 적용될 준거법 결정 문제에 있어서는 국제사법에 관련 규정이 불충분하거나 규정이 있더라도 그에 의하여서는 준거법을 결정하기가 어렵다는 점이 확인되었다. 후속연구를 통해 가능한 해석론을 찾거나 다음 국제사법 개정을 위한 입법안을 모색할 수 있기를 기대한다.

The metaverse, which is being pointed out as a new paradigm for the next-generation Internet, has received growing attention across the world and the investment in metaverse-related industries has also increased rapidly. This suggests that disputes in the metaverse will increase in the future. This article 1) investigates the terms of service of currently well-known ‘metaverse’ platforms and analyzes foreign cases involving metaverse platforms, 2) creates hypothetical cases that might arise with respect to metaverse platforms, and 3) applies the 2022 Korean Private International Law Act to those hypothetical cases. This research shows the following: Although the international jurisdiction part of the Act on consumer contract, intellectual property infringement, and torts has been amended considering online environment such as metaverse, that is not the case with the part on general contract. In particular, the Act is not complete enough to determine applicable law to disputes arising from online environment. Therefore, further research is called for practical interpretation of such provisions or future revision of the Act.
