기술탈취문제에 대한 시장경쟁자의 전략: 선두주자와 후발주자의 진화게임을 중심으로

Abstract

본 논문에서는 시장에 선두주자가 진입하고 이후 후발주자가 선두주자의 기술을 활용하여 동일한 시장에 진입하는 상황에 있어서, 2자 간의 진화적 게임 모델을 설정하고, 복제 동적 방정식과 리아프노프 안정성을 만족하는 조건을 도출함으로써 진화적으로 안정한 전략을 결정한다. 후발주자는 선두주자의 기술을 탈취하여 유용함으로써 선두주자에 손해를 입히고 시장질서를 교란시킨다. 이 경우, 선두주자와 후발주자 간의 진화적 게임에 따른 안정적인 균형 상태는 선두주자가 소송에서 얼마나 유리한 지에 따라, 선두주자가 소송을 제기하지 않고 후발주자는 기술탈취를 선택하거나, 선두주자는 소송을 제기하되 후발주자는 소송중 합의를 유도하거나 또는 선두주자는 소송을 제기하고 후발주자는 기술탈취를 선택하는 상태로 수렴할 수 있다. 이때, 합의금은 시장규모, 소송비용, 기술료, 손해배상액에 달려 있다. 본 논문은명백한 기술탈취 사안에서 선두주자의 승소 확률이 증가함에 따라 선두주자는 소송을 제기하고 후발주자는 소송중 합의를 취하는 전략이 진화적으로 안정한 전략임을 설명함으로써, 선두주자와 후발주자가 시장에 공존하면서도 시장경제의 논리 하에서 선두주자의 지위를 보호하는데 기여할 것이다.

In this study, we set up an evolutionary game model between two parties in a situation where a leader and a latecomer enter the same market using the leader's technology, and derive the conditions for satisfying the replication dynamic equation and Lyapunov stability, an evolutionarily stable strategy is determined. Latecomers steal the leader's technology, causing damage to the leader. In this case, the stable equilibrium state between two parties depends on how advantageous the leader is in litigation: the leader does not file a lawsuit and the latecomer chooses to seize the technology, the leader files a lawsuit but the latecomer induces a settlement during the lawsuit, or the leader files a lawsuit but the latecomer chooses to seize the technology. At this time, the settlement amount depends on the market size, litigation costs, technology fees, and damages. This study explains that as the probability of victory of the leader increases, the strategy of the leader filing a lawsuit and the latecomer reaching a settlement is an evolutionarily stable strategy, so that the leader and the latecomer can coexist while it will contribute to protecting the leader's position.
